I just want to imprint the idea as much as possible that specials are the SMALLEST part of the MIST case, that damages for pain and suffering, as it were, are Greater than the medical bills.
This is an uphill fight we slog all the time w crappy little connective-tissue cases. You can address it in voir Dire but this is a visual impression of that point--simply that "Pain and Suffering" is greater than the medical bills.
If you don't do all this, including hitting the point again and again in voir dire, the good old boys on a jury are going to give you medicals plus $2K for pain and suffering in a 3 hour jury trial and feel like they did you a favor. |

The pie chart is really for crappy cases where you have to try hard to get 2X specials in verdict in most states--I'm not talking about California insanity where of course they are going to give you pain and suffering because they've been listening to your experts for three days. |

This is a DREAM if you can get liability against anyone other than the shooter.
Make sure you leave a big trail of complaints about "why wont they just settle w me" to the therapist to counteract any stipulation to liability at the last minute. |

You can start feeding him grievances to relay to therapists which will then lend support for your P&S arguments at trial.

his general doc already gave him xanax butt i told him we need a forensic psych with courtroom experience and a psychiatrist for he anti anxiety scripts to diversify his damages with specialists where possible. |
