I have a friend who signed a severance with his employer. He was sexually harassed allegedly, complained, and then got canned. The severance released the company and doesn’t have the usual language to include the company’s employees, agents, etc. as released parties. And doesn’t include the name of the alleged harasser. Can he sue the individual harasser? If he can, the company will defend and indemnify her right?

Why would co indemnify? Unlikely to be in employment agreement.

I’m pretty sure a company has to indemnify under CA law. That’s my understanding at least. Want to make sure. Anyway can he sue the harasser?

Idk man. Idk. But that would be a problem. He needs a deep pocket even though I doubt he’ll get very much.

But can he sue? Is she released under the severance? I’ve never seen such a retarded release in my life.
