The facts are simple. The HRC campaign purchased disinformation about Trump from literal Kremlin agents. After 3 years of investigations costing tens of millions of taxpayer dollars, Mueller (and others) have not filed a single indictment against any American for Trump's alleged conspiracy with the Kremlin to steal the 2016 election.
I find it fascinating that Roger Stone is facing life in prison for lying about allegedly seeking dirt on HRC from Wikileaks. So let's get this straight. HRC purchases dirt on Trump from Kremlin agents: no big deal. Roger Stone tries to find out about dirt on HRC from Wikileaks: life in prison.

My biggest frustration with the reporting and analysis of the investigation is the failure of all sides to appreciate the difficulty in prosecuting white collar and public corruption cases. Courts and prosecutors have had a lot of difficulty in determining what behaviors and activities fit within the elements of theft of honest services, defrauding the US, conspiracy to hack etc. And the case law on a lot of these issues is still new and/or sparse. Basically, the line between what is legal and illegal is very blurry. A lot of these cases get overturned. I don't think that means we should disband public corruption investigations. They are obviously important, but they are difficult to win in the lower courts and on appeal.
It's stupid to assume that evidence of coordination with Russia requires Mueller to indict. But it's also dumb to argue Mueller's failure to indict for conspiring with Russia exonerates Trump and the campaign. In fact, Mueller's prosecution of stone, manafort, gates, etc. for various crimes may show that he finds their behavior worthy of prosecution but that his tools for attacking the conspiracy are not adequate or would be on shakier grounds. Mueller is not going to indict anyone on a novel legal theory. No way would he expose any of his work to a legitimate appeal.
This is something I've been saying since the start of the investigation. I think it's unfortunate that the "legal scholars" that the media always interviews fail to really discuss or appreciate this. |

Plenty of defense attorneys for corporate and government officials make the same argument. It's difficult for sure in these kinds of cases. That's not necessarily the prosecutor's fault either. It's impossible to create statutes and a body of case law that can always and clearly delineate corrupt/illegal conduct and legal activity. |
