SB 360 requires priests or anyone hearing confession to report to the authorities any suspected child abuse when the information was gained from a religious confession from either another clergy member or someone who is an employee of the church/school/institution.
This goes further than the lawyer exception to privilege where we are PERMITTED to snitch to prevent an imminent death or serious bodily injury - this bill REQUIRES priests to snitch if they suspect abuse, including past child abuse.
I'm no papist but I think this is fucked up and it would be nice to see the 50 million catholic mexicans here firebomb Sacramento. This is the first time in US history where the state has tried to pierce the confessional relationship for "mandatory reporting" requirements.
Note that the bill was amended - previously clergy were going to have to snitch on ANYONE confessing child abuse, not just other priests or employees.

The lawyer privilege is stronger and the confessional privilege used to be the strongest - especially since for catholics anyway, any priest who breaks the confessional for any reason will be automatically defrocked AND excommunicated from the church, which is a big deal.

(and if the priest is so corrupt as to not do this, neither will he abide by the law. and if the penitent is going to flout the priest's advice, neither will he confess to cops).
Publication of this law only alerts the paedo to tell absolutely no one. Fewer cases will be reported, overall.
That's just pragmatic, not even getting into church/state.
