For background, this is a disputed liability case where my client suffered a shoulder tear and neck injury. My client was washing his car with headphones on when a tow truck tried to squeeze past him in a parking lot and struck my client with his large side view mirror. Client had no history of shoulder or neck pain. He is recommended for a shoulder surgery and is recommended for cervical epidurals.
Pre-litigation, the insurance company took the position that our client stepped into the way of the truck and injured himself. The defendant's discovery responses state the same. They offered $20,000 to settle before we filed.
The point of my deposition was to get liability resolved.
