For background, this is a disputed liability case where my client suffered a shoulder tear and neck injury. My client was washing his car with headphones on when a tow truck tried to squeeze past him in a parking lot and struck my client with his large side view mirror. Client had no history of shoulder or neck pain. He is recommended for a shoulder surgery and is recommended for cervical epidurals.
Pre-litigation, the insurance company took the position that our client stepped into the way of the truck and injured himself. The defendant's discovery responses state the same. They offered $20,000 to settle before we filed.
The point of my deposition was to get liability resolved.

The jury can already infer that he was lying, and you can lead them to that inference in closing argument. Asking him such a pointed question just gives him an opportunity to crawfish out. If I understand you and Chandler correctly, the depo is partly a preview of trial but also an opportunity to get ammunition for your pre-mediation demand. This way, you can include in that demand “Defendant admitted to perjuring himself” and cite that depo portion as an argument against his credibility, which helps you establish liability.
