You are losing 50% revenue off the bat. Explain the business decision/thought process behind this?

This is an easy question. I have hundreds of files and they take an extraordinary amount of time to handle. Moreover, my biggest skill is in bringing in new files.

Some of these big cases can have dozens of depositions, weeks of trial, dozens of hours of discovery, and significant planning. It would take several people in my office just to work on one or two of these big cases.

I have a case right now I'm co-counseling with a big firm that has over 60 experts (20 of them designated experts). They take and defend every single deposition. On top of that they are paying 100% of the costs, which is at the moment over $200,000. Finally, there is no way that I could get at trial the same dollar amount as someone like Nick Rowley. He is just the best at what he does. So I still will likely make more money sending it to him than if I were to do it my self.

So basically, my firm is VERY good at getting max value on small, mid-size, and large cases. We try a lot of cases every year. Since we farm through hundreds of cases per year, we are able to get a few monsters every year that we outsource to the best trial attorneys in the country. Then we get nice pops every so often. Seems like it makes the most economic sense. It is also best for the client too since we make sure their recovery is always the max.

there's a difference between just running a mill and knowing how to work up and try a case. cslg's firm can do it all, but why wouldn't you outsource the highest value cases to the best trial lawyers? biglaw firms do this too internally all the time.

Whats your referral "co counseling" fee for something like that? Ethically doesnt it have to be proportional to the time you a actually spend on the case?

that's basically what i'm saying. you can assess the merits and send a nasty letter, and collect your percentage if they settle, is my understanding. i'm aware of no state bar adjudications or advisory opinions plainly to the contrary.

There’s no requirement in California of a work split unless there’s a separate rule outside of 1.5.1

We have a signed rule 1.5.1 agreement. I don’t think there’s any work requirement under the new rule. I believe you can refer out a case, take 50% and do nothing on it as long as it’s in writing.

I do wonder how much a product of CSLG’s success is due to being in CA. I think he would have been successful other places, but not at the same margins. E.g., PIP would have precluded a lot of the cheap soft tissue cases he relied on to build his practice .
