How do you handle if made out to client? Can you deposit into trust account if it’s made out to the client instead of you?

i usually tell them to write two checks; one to the client, one to me, both mailed to me. only if there's 3rd party lienholders do i request one check.

I tell them to write the check out to me & client, just in case they "make a mistake" and mail the check directly to the client.

I have it in the retainer agreement that I have the authority to sign their name in order to deposit the check into my IOLTA

Are you guys using "power of attorney" as a term of art? Powers of attorney are arduous to execute, require a notarized signature and witnesses usually, etc.

The retainer agreement includes POA to deposit checks on CL's behalf; carriers around here usually make payable to "law firm and client's name" anyway; we agree to carrier to cover liens; when case settles but before check arrives CL signs an additional authorization to deposit; we have a relationship w a local bank for prompt processing when we get the check and deposit it and wait for it to clear.

Check clears, then at that point we cut check to client and checks for liens and of course for our fee, then client comes in, signs release and settlement statement. Then gets his check. settlement statement shows where all of the money is going from the check that came from carrier to us.

You can do it a number of other ways as well.

Are you going to keep doing this ad nauseum? What support to do you have for this terrible allegation.

Spaceporn the proof is all over xo. That’s why you retired in shame last year and we all know it.

When there’s mountains of evidence against you, I think it’s more than appropriate for us to all ask whether you have any support that you *don’t* abuse your wife’s son.

Great! With mountains of evidence of this terrible crime you should be able to produce something at least--something that shows I'm doing this terrible thing. Go ahead. It's a standing invitation. Link?

As for "retiring in shame last year"--I know that gratifies your psychopathic tendencies to think that, but that's not actually what happened either.

Don't respond to this unless you have some evidence that I am committing that terrible thing you've accused me of. And if you don't, it means youve been blown out yet again and should just move on to another target.

I'm just laughing at how fuming you must have been to be scanning xo at 4 am to jump in w this. I'm sure you must have been super tired from another week at your super great professional job (whatever it is) and your big head from your two degrees from Cornell (lol) but that didn't stop you from "pouncing" like a massively obese puma that broke the branch under it you fucking obesessive 100% psychopath. Fuck off and find another target because its not me anymore.

Do you include language in the settlement statement closing out the case and ending the client relationship as well? If not, how do you formally close out the case?
