This has been recognized forever and many such amendments have been proposed and failed; the Dem switch now to claiming that congressional approval alone will work is a tactic taken out of necessity (the impossibility of an amendment), not viability. The text of the Constitution is actually laughably clear. They can do Puerto Rico with an Act but there're more barriers to this stuff than today's Hastings-grad xo poaster appreciates. |
