By using the coordinated conjunction "and," the framers implied that being in office is a condition precedent for judgment in cases of impeachment. If the party on trial no longer holds the office subject to impeachment, then it would be an unconstitutional extension of the Senate's impeachment power if their judgment extended to the more general "disqualification." Both removal from office and disqualification are of equal syntactic importance. |

It's an unconstitutional extension of power to disqualify but not remove, remove but not disqualify, or neither remove nor disqualify.
While I understand that impeachment trials have historically included a separate vote on disqualification after the vote on conviction, I don't think that's proper. The Constitution's "shall" language in Art. I, sec. 3, cl. 7 separates impeachment trials from trials on any criminal misconduct for which the officeholder was impeached, and constrains the powers of the Senate. The punishment for impeachment & conviction is removal & disqualification. |

That kind of thing should be encouraged. It's just like plea deals allow someone to "get out of" the statutorily authorized (in some cases mandated) sentence for their crime. The trade off is judicial efficiency. An impeachment trial of the president requires the participation of the entire senate and the chief justice of the supreme court... If the president resigns, he could still face criminal prosecution. |
