not following either, but believe based on what xo says and evidence that's already come out before trial that acquittal is clearly the credited result based on any fair application of BRD to either the causation or mens rea element. xo seems to be of the opinion that fair application of BRD is unlikely.
I remember I *did* follow the zimmerhero trial fairly closely, not only on xo but actually watching the trial broadcast many (though not all) days. I thought he should be acquitted too, obviously, but I can't for the life of me remember what I thought the actual result was going to be prior to the verdict announcement.
