Here's what happened. I came upon a guy who seemed like he was running a scam on Whatnot. So I started bidding.
I bid and won over 150 auctions.
I immediately tried to return the items thinking that this guy would let me do a return if he wasn't a scammer.
He said no.
I immediately escalated to Whatnot in California and they largely ignored me.
Then I started receiving the items. I opened them up and realized they were not what was shown during the auction at all. I immediately wrote a demand letter threatening legal action if the mistake wasn't corrected.
I also sent a litigation hold letter to Whatnot to preserve evidence and a copy of my demand letter letting Whatnot know that I was being defrauded.
Then I found out yesterday that the guy actually running the Whatnot is a convicted felon, specifically for theft, and he's still on probation for it. (Arrested in '22, pled guilty in '23, on probation now). So he's a convicted thief and he's still stealing.
My next escalation is going to be to file a lawsuit and report this to his local probation officer, the U.S. Postal Inspection Service, etc.
What a mess.
On the upside I should get like $40,000 in fees out of this.
