The alleged cover-up of payments didn't impact the 2016 election. Had Trump recorded the payment as a campaign contribution it would have been reported after the election.

DA keeps arguing that he swung an election through this "cover-up" but the argument makes no sense because of the timing.

Paying the whores is not a crime. The legal argument is that when he paid the whores he was making a campaign contribution (which is also not a crime) but he failed to report it (the alleged underlying felony) by using fraudulent business records (which is a NY misdemeanor elevated to a felony because it was to coverup another crime). Yes this is nuanced but the DA needs to allege a crime and then tell a story to convince a jury. The story that this crime swung the election cannot be true because the "crime" occurred well after the election (even if the crime is the failure to report -- which again isn't what the charge is here).
