Ocala man shot, killed while gardening in his yard, suspect in custody, police say
OCALA, Fla. —
A 64-year-old man was fatally shot while gardening in his Ocala yard on Wednesday, leading to a homicide investigation and the arrest of 29-year-old Isaac Ezekiel Toye, according to the Ocala Police Department.
The victim has been identified as Harold Whitt Harper.
Ocala Police Chief Mike Balken reported that two calls were made from the neighborhood near SE 3rd Street and 11th Avenue, the first about a suspicious person and the second about a shooting.
Balken said the first call came in about a suspicious person around 3:34 Wednesday afternoon on Southeast Third Street, who tried to wave down a person pulling out of their driveway
"As he was pulling away, he observed the subject doing something suspicious, appearing to manipulate a handgun and possibly chamber a round in that handgun. Officers were immediately dispatched to the area," Balken said.
Officers were arriving in the neighborhood, within three minutes of that first call, the police chief said.
"We received a second call in reference to a shooting. That second call originated just down the road. This is about a block away to the east, involved our victim who had been shot,"
Because officers were so close by, he said they were able to find their suspect, Toye, walking away from the shooting scene. He matched the description of the man from the first call to police, and the chief said he had a gun on him.
The chief stated that no motive has been identified, and there is no indication that Toye and the victim, Harper, knew each other or even interacted before the shooting.
"It appears that he was doing nothing more than gardening in his front yard, and was senselessly killed. This is, you know, I've been here for almost 32 years, and I've never seen anything like this," Balken said.
Toye was escorted out of the Ocala Police Department in handcuffs on Wednesday night, remaining silent about the accusations against him.
"This horrific incident appears to be a random act of violence. There is no indication, I'll repeat, that. There's no indication that this was a targeted attack," Balken said.
Toye faces two counts of aggravated assault and one count of second-degree homicide. The police chief noted that officers have had minimal contact with Toye in the past, and while he has no criminal history in Ocala, the chief believes he does have some in Tampa.
