What a stupid, pointless tantrum. They aren't going to "defund DHS" or whatever nonsense they want. Maybe they shouldn't encourage agitators to have confrontations with law enforcement in the cities they run

also you don't have to vote for it. you just have to not filibuster, i.e. employ antidemocratic procedural tactics.

when it comes to CRs, the Republicans do not "control" at all. any party with 41 Senate votes can shut the government down. it used to be Republicans, now it's Democrats.

first, Congress stopped following the budget process laid out in the Constitution back when Clinton was POTUS.

second, the current process of kicking the can down the road -- continuing resolutions -- can be blocked by either party at will because of the Senate filibuster threshold requiring 60 senators.

third, shutting down the government was done over and over by Republicans and they got hammered for it. but now the shoe is on the other foot. Schumer shut down the government because he feared getting primaried by AOC.

It doesn’t require 60 votes. The senate can override the 60 vote requirement with only a majority (like Republicans did to fill SCOTUS seats).

Republicans can either open the government on their own with zero democrat votes or do a deal with the democrats.

fair point. either party could, if they cared to, eliminate the filibuster rule for budget issues.

Dems never did that in all the previous shutdowns and Republicans didn't in the recent one. eliminating the filibuster more broadly risks turning your party into a non-entity, so there is a bit of a standoff.

IMO the rubicon here was already crossed once SCOTUS nominees only needed 51 votes and the remainder is on borrowed time.

Not saying ending is NBD, but republicans can open the government with zero democrat votes and that’s 100% true. Dear leader Trump has in fact asked them to do this multiple times.

If they want Democrat votes, then they can’t just shove any shit they want in front of them and say go ahead and sign. Come to the table and do a deal.

The gestapo is polling quite low right now given the recent executions, so I think Democrats have even stronger political cover compared to last time.

yeah that's fair. the establishments of both parties like it because it excuses them from ever doing anything. they can just "compromise" with pro-gc drek and then blame the other side for it.

you're right that it is technically within the gops power right now. but the gop isn't monolithic -- there are plenty of GOPe faggots just like there are plenty of corporate neolibs, and that bipartisan alliance is the real reason it hasn't been eliminated yet.

if they didnt do it last year during BBB fighting and the last shutdown i doubt they are going to this year. if it does get nuked it'll be right when a new congress comes in. they're not going to do it so close to the midterms.

there have been significant consequences from chevron. but that has nothing to do with what im saying. im saying if the legislature starts working again scotus will have to unwind all the jurispridence they've created to make exceptions for POTUS or the judiciary doing it in their stead. it's just a lot of work but it won't matter to anyone but lawfags.

Given the expansion of Presidential powers I can't exactly see how Congress could find a way to reassert itself. It would take generations. They would have to all work together and collectively block nominees and wait til the SCOTUS was entirely replaced. It's just not plausible.

what are you talking about?

1) the current scotus is pretty skeptical of potus infringing on the legislature. see e.g. bidens student loan EO being blocked, and countless trump EOs.

2) the potus+legislature could pack the court or limit it's jurisdiction to almost nothing. they wouldn't have to wait fkr justices to die.

1) I see mixed messages from the court. It really depends on what doctrines are at play. They're not afraid to take expansive views of Article 2 powers.

2) That's a good argument for keeping the filibuster alive for legislation. Keeps us safe from crazy partisan acts.

1) in the absence of legislative action, which is always justified with "well congress must have ascented..." they can't justify potus legislating something differently from the legislature with potus borrowing their power somehow. so i dont see how there would be much of an issue with "congress reasserting itself."

2) i disagree but fine. but my point isn't whethet it's a good or bad thing, but only that potus+congress dont have to sit around and wait for justices to die if they disagree with the courts decisions.

the reason scotus has expanded potus power is because the legislature ain't doing shit. all the decisions which bless potus expanding power is based on congress delegating or authorizing it in some way. and scotus hates blessing that too (e.g. EOs that got overturned still have majority congressional support usually, but not enough to get past filibuster.)

in a situation where congress *is* passing law and potus is trying to EO his way around it, scotus would have nothing to rely on to side with potus. and the sitting scotus wouldn't want to anyway. and thats cons, libs hate powerful potus even more. so there's really no scenario i can imagine where scotus starts saying potus = power to legislate.

very high. it was never intended and is a boomer relic of a functional bipartisan congress. as the legislators who like and profit from the status quo die off the new ones who actually want change have an appetite for getting rid of it.

it'll happen after a potus election when potus controls both houses. unless it's an obama huckster that doesnt really mean what he says, that potus will want to get rid of it to actually pass what he promised. trump has called for it but he isn't trusted or influential enough to force it. kamala did too, although superficially as per usual.

momentum is in favor of it and unless congress starts working it seems inevitable. eventually people will get tired of every budget requiring a game of brinksmanship over jow long they'll tolerate the government being shut down. you can't run a government that way.

I agree. Hope to see it soon. It would be nice if we just do one party wins > they run the show and do whatever. Don't like it? Focus on the campaign. That's how it should be done.

that's how it's designed to work!

when someone pointed out that the cloture rule meant someone could yap in perpetuity the founders were like "lol wut it'll never happen, a single person taking up floor time so a vote can't happen?"

the non-talking filibuster is a far crazier advancement on that.

no one *EVER* thought ordinary legislation should need a supermajority. it makes no fucking sense and we're seeing the results of it.

Agreed. It would really help to end the showmanship about protests and all the political performances. If winning actually means something and you have to govern, then I think candidates would be much more serious about their campaigns.

yup. that's literally how it's designed to work. i think fewer people would be so checked out too. people are protesting, etc. in part because they can't meaningfully impact things. i think if people voted and lost they'd be more willing to accept the results. as it stands now everyone is angry because even when they win at the polls norhing happens. sure there will be minority party sour grapes, but they'll just look like sore losers.

I'd be willing to bet anything if you polled the nation Congress has the worst reputation. Most dysfunctional of the three branches by far. And I think it's because these people use it for personal gain way too often. It's the lowest barrier of entry and the easiest to enrich oneself over time. Too many scammers.

I think they ought to get rid of it and force themselves to govern

last time they shut government down they won some concessions and the GOP took most of the blame for the shutdown. so why not do it again when trump and the gop is hitting some new lows in polling.
