I own a rental property and paid $4k to have 2 huge old growth trees cut down last week. Then we had unseasonable rain for days and a big windstorm and it blew down many trees in the area.

The property behind mine across the alley had 2 huge red firs blow down and crush the house, leaving the renters (nice white working class xbox type proles) homeless for Christmas blah blah blah. The owner of the place, a boomer slumlord is arguing that me cutting down my trees when I did added "wind stress" to his trees and is saying he's going to come after me for it.

Normally I wouldn't worry because it's an absurd argument but this town runs on who you know and he's an old timer who is probably friends with a corrupt judge idk should I hire a lawyer?

If you in no way trespassed on his property and did. Nothing but remove your own trees and there’s no other ageeement between you and that’s his only argument then yeah I agree that’s ridiculous.

Bad advice. He could be fucked by his deed, his HOA, or municipal code.

The trees are cut down so he shouldn’t worry about it until he gets sued.

no

if you actually do get legally pressed on this, just lie and say that the trees were damaged in the storm, and that they were leaning toward your structure and you had to cut them down as a time-sensitive emergency before they fell

i've been involved in this exact kind of dispute before and this worked

Jesus.

Obviously it's going to cause wind stress on the neighbor's trees if you just cut them all down suddenly like that. You need to prune them first, wait a while, then cut them down gradually one by one over a period of several months in order for the neighboring trees to build up their natural wind resistance.

If the town is corrupt, you should tell him up front that you will appeal any frivolous bullshit lawsuit all the way up to the state Supreme Court and then federal court. Say it right away to deter some frivolous action that he can bring in front of his buddies, so that he knows the time and money is not worth it.

if you were negligent in your property upkeep including trimming dangerous trees, he might have a case. otherwise, good luck him proving 'wind stress'. show me the bylaw that speaks to that.

Oh another story about this landlord I just remembered, every few days or so he'd drive down the alley "checking out" his property.

So one time I had another guy pruning the apple trees and he had removed the wire cages around the trees and put them next to the alley, and this dumbass boomer ran over one and it wrapped around his wheel and scratched the absolute shit out of the side of his car. He got out and yelled at my pruning guy who is likely mentally disabled in some sort of way and said he was going to have to pay for the damages. Nothing ever happened there.

But I did tell the neighbors he was driving by all the time and creeping on their daughter and friends playing in the pool, and the dudes brother in law is a city cop and somehow got him to stop doing it. A lot of tree related shenanigans with this guy.

i guess a clever atty could claim some sort of private nuisance that youve created by modifying your yard but i dont think you have to contemplate "wind resistence" for your neighbors otherwise any time you want to alter some aspect of your yard you'd have to get neighbors ppermission first.

I really don’t see how there’s any liability there if case was as you presented.

Mr screens is trying to make his ONE tree case into YOUR case but that’s not lawyering. I have done tree cases before. No one would require you to do a tree study for “wind resistance” for neighbor’s trees. You don’t need to lie about the condition of the trees and an atty shouldn’t be counseling you to lie about it if he knows what he is doing.

The trees blew down in the direction where my trees were. Also its common knowledge among arborists & foresters that trees fall when they're newly exposed to wind cause they haven't been strengthened by dealing with years of wind and all the cracking and regrowth that makes them more resilient just like someone lifting weights is stronger than someone who doesn't. Now whether I'm liable for this I don't think so.

I had to remove a tree once (in a city) from my property because it was dying from a fatal fungal infection, was also leaning over and poorly pruned. These trees live like 70-90 years and it had to have been 50-60 years old at the time.

It was a 6 month fight to take it down; with hearings and everything. 3 gay hippies in my city unconditionally protest tree removals of any kind. This tree was non-native to the area.

A year later two trees of the same type blew down in a storm and fucked up

streets/power lines and cars. They would have killed anyone walking under them. If my tree went down that way it would have fucked my structure up or killed people and I would have been sued.

What a joke - to fight and spend a ton of money just for the privilege of protecting your property and not getting sued.
