Sacramento, California – Governor Gavin Newsom today announced that he has signed AB 1780 by Assemblymember Phil Ting (D-San Francisco) to prohibit legacy and donor preferences in the admissions process for private, nonprofit institutions. Legacy status and donor preferences have long been excluded from the state’s public university admissions process. The University of California system eliminated legacy preferences in 1998.
“In California, everyone should be able to get ahead through merit, skill, and hard work. The California Dream shouldn’t be accessible to just a lucky few, which is why we’re opening the door to higher education wide enough for everyone, fairly.”

what do you think PREVENTS california from doing this? california law or federal law? there isn't some magic force that limits the power of the state.

you are very confused. there is no supernatural force that prevents a sovereign government from creating law. it doesn't matter if it's "legitimate" or not. what entity would even make that determination? and who enforces it?
you seem to be trying to apply rational basis review, which occurs when state law conflicts with federal law (i.e. the constitution). but there is no constitutional right this law conflicts with.
again, im not discussing whether this law is good or wise. but only what you think prevents a sovereign state government from enacting any law. you said the state didn't have the power to do this.

you seem to be saying that this wouldn't pass rational basis review. this is hilarious and ironic on several levels.
1) you, a states rights libertarian, are now using federal law to limit a states sovereign power. im not sure you even understand what you're arguing, but you're essentially saying the due process clause limits a states ability to regulate private enterprises in this manner.
2) every law passes rational basis review. it's easy to think of a billion legitimate state interests that are setved with this. but we don't even need to get there, because this doesn't even conflict with the constitution, absent a very broad interpretation of the due process clause that would essentially federalize everything and leave the states powerless.
3) you relying on this law being non-race based makes it misplaced. you seem to think that because this does not involve protected classes a state has less power, but the opposite is true. this is when a states power is highest.

in a completely alternate universe, i'd like private universities that take $1 of federal money to still be able to make their own decisions on all sorts of issues. i don't like the current regime of "you took the king's schilling and now we will regulate you completely." so i'd be ok with private universities doing mostly whatever the hell they want to, so long as they are open and honest about it.
in the real world, this sort of law has mixed results, i think. it weakens alumni support at the margin. but it means that rich kids don't have an inside track.

Assuming the Due Process Clause of the Fourteenth Amendment incorporates most provisions of the Bill of Rights (which I think is bullshit, but is how it is) into the application state law -- I never understood how any laws like this don't violate the first amendment.

the defense against eliminating legacy admits is that stanford is an elite university and there are factors that are more important that academics, like character, leadership ability, chads who come from long lines of prominent families who have served the country in high profile govt roles or have been generals or have succeeded in businesses to a really high degree, and that the potential of those students is worth far more than a superstudy who will get 1600 on the sats but otherwise has no civic or redeeming character or qualities
of course rationale works when you have noblesse oblige but those days have long since passed and every one of them are going to work for blackstone or whatever so this is a good thing overall

A few points on this:
1. Legacy admits were not really underqualified. On average i believe they had higher test scores. I have no problem with schools reducing the randomness of the admissions process for people who have a history with the school.
2. AA wasn't really a problem it was the magnitude of AA. People would've been okay if 1 out 4 asian kids with a 1500 SAT score got in while 4 out of 4 black kids did. The problem is when 1 out of 10 Asian kids with a 1500 get in and 4 out of 4 black kids with a 1200 get in.
3. Big donors obviously get in - I'm sorry this is America. You don't take $20 million from someone and then reject their grandkid if he's anywhere near the requirements. We learned from the celeb scandal this type of admissions requires millions - and you have to be a complete moron to think that the entire student body isn't better off having a billionaire's kid there.
4. The celeb scandal showed that these schools are way too MEROCRATIC for their own good. Why can't Lori Loughlin's kid get into USC just because she's Lori Loughlin's kid? She was hot and has 1 million followers on Instagram? You don't think there might be some benefits to having celeb kids in a school known for hits film school? Jonah Hill and i'm sure many others were discovered becase of their friends famous fathers.
You don't go to Stanford because of the lectures - you go there because its (i) signaling that you're smart and (ii) putting you into an elite network. AA killed (i), conversely this ruling would kill (ii).
