holy shit do libs have shit for brains and newsom is nothing if not a lib

Sacramento, California – Governor Gavin Newsom today announced that he has signed AB 1780 by Assemblymember Phil Ting (D-San Francisco) to prohibit legacy and donor preferences in the admissions process for private, nonprofit institutions. Legacy status and donor preferences have long been excluded from the state’s public university admissions process. The University of California system eliminated legacy preferences in 1998.

“In California, everyone should be able to get ahead through merit, skill, and hard work. The California Dream shouldn’t be accessible to just a lucky few, which is why we’re opening the door to higher education wide enough for everyone, fairly.”

Governor Gavin Newsom

the proposed new law is in response to not being able to use race in applications, however, not because newsom is some merit proponent. like with every lib, quite the opposite

do you believe the state can even dictate to a private university what non-racial, colorblind factors it can use for admissions?

yes? what are you talking about? the state has police power. they can do anything that isn't prohibited by federal law. certainly that includes dictating admissions policies even for private universities.

what do you think PREVENTS california from doing this? california law or federal law? there isn't some magic force that limits the power of the state.

note i'm not endorsing this policy, just pointing out how your understanding of how federalism and the law generally works is a libertarian mishmash of nonsense.

what is the legitimate governmental interest served by this?

it's easy to explain why legacy admits and donor preferences are beneficial to a college, but why would the government actively depress donations to a school or have any basis to do it, particularly when it comes to private schools?

you are very confused. there is no supernatural force that prevents a sovereign government from creating law. it doesn't matter if it's "legitimate" or not. what entity would even make that determination? and who enforces it?

you seem to be trying to apply rational basis review, which occurs when state law conflicts with federal law (i.e. the constitution). but there is no constitutional right this law conflicts with.

again, im not discussing whether this law is good or wise. but only what you think prevents a sovereign state government from enacting any law. you said the state didn't have the power to do this.

You have the analysis backwards. A court must determine that a constitutional right is implicated prior to determining whether the law is rationally related to a legitimate governmental interest.

Also, the governmental interests here could be stopping disparate impacts against minorities and ensuring merit-based admissions in the context of postsecondary education. But under rational basis review, a court must find for the validity of the law if there is any conceivable legitimate interest.

it's obvious he thinks that rational basis review is some super analysis where laws are invalidated by federal courts when they don't serve a "legitimate interest." and what's really funny is that he doesn't even understand how much this would broaden federal power in a way he is against.

sealclubber has a very mystical conception of how the law works. the federalism thing shit is just gibberish. he believes that there is some super-legal entity that has the power to invalidate a sovereigns lawmaking power if it conflicts with his conception of what powers a sovereign has. as if God would come down to invalidate a law.

"no! a state can't do that! it's not legitimate!"

can someone that speaks sealclubber translate this for me?

you seem to be saying that this wouldn't pass rational basis review. this is hilarious and ironic on several levels.

1) you, a states rights libertarian, are now using federal law to limit a states sovereign power. im not sure you even understand what you're arguing, but you're essentially saying the due process clause limits a states ability to regulate private enterprises in this manner.

2) every law passes rational basis review. it's easy to think of a billion legitimate state interests that are setved with this. but we don't even need to get there, because this doesn't even conflict with the constitution, absent a very broad interpretation of the due process clause that would essentially federalize everything and leave the states powerless.

3) you relying on this law being non-race based makes it misplaced. you seem to think that because this does not involve protected classes a state has less power, but the opposite is true. this is when a states power is highest.

but if you take even one dollar of federal money you are deemed to have agreed to the regulations, as i understand it.

in a completely alternate universe, i'd like private universities that take $1 of federal money to still be able to make their own decisions on all sorts of issues. i don't like the current regime of "you took the king's schilling and now we will regulate you completely." so i'd be ok with private universities doing mostly whatever the hell they want to, so long as they are open and honest about it.

in the real world, this sort of law has mixed results, i think. it weakens alumni support at the margin. but it means that rich kids don't have an inside track.

what do you think?

Similar to favoring low inheritance taxes, because a lot of motivation for the individual to succeed is to make life better for his descendants. A school that allows this to happen ensures that older graduates stay engaged with supporting the institution instead of just spreading their support to wherever their kids get in. There's something neat about the continuity.

You could convince me that considering legacy should be banned, though, even though having multiple family members attend the same university is still cool and beautiful. I tried to make the argument for legacy above

Suspect the promise of legacy admits is a huge money-maker for the elite colleges. They're not using legacies to perpetuate some waspocracy that died out in the late 1960s. The *only* reason I donate to my alma mater is on the off chance it helps if my kids want to apply in a few years. Which I also struggle with because my alma mater isn't what it was 20 years ago and is a shitlib tyranny and I'd rather the kids go somewhere sane. If legacy plays no role in admissions, my donations stop immediately.

absolutely - I'm sure there are a lot of guys thinking like you. and schools know legacies increase donations, which is a big reason why they do it. and similarly, i know what you mean about how sad it is to see once great institutions become ideologically misguided. I still see some romance in the tradition of having multiple generations attend a school if you can manage it, idk, maybe that's overly sentimental.

https://nypost.com/2022/11/15/jennifer-siebel-newsom-wife-to-california-gov-asked-to-fake-an-orgasm-in-court-during-harvey-weinstein-trial/

The distraught former actress-turned-documentary filmmaker admitted on the stand that she faked her orgasm so Weinstein “would be done.”

“I was making noises to get him to finish,” Siebel Newsom said in tears. “He had already raped me. … This is so gross. I’m sorry.”

When Werksman peppered Siebel Newsom with questions concerning details about her prior testimony regarding the alleged rape, she replied: “What you’re doing today is exactly what he did to me.”

https://nypost.com/2022/11/14/gov-gavin-newsoms-wife-breaks-down-describing-harvey-weinsteins-fish-like-penis-in-court/

During his opening statement, Werksman made a dig at Siebel Newsom, saying: “Today she is the wife of Gov. Newsom. She’s the first partner of California … She’s made herself a prominent victim in the MeToo movement … otherwise she’d be just another bimbo who slept with Harvey Weinstein to get ahead in Hollywood.”

I have come to the conclusion that I am not really against AA or legacy admits. I guess you could base admission on some weighted scale of standardized testing, grades and extracurriculars (even these are questionable on pure merit based admission, maybe) You get above a certain score you get into UTexas or Harvard or whatever. But I don't really see that as being any better than what we had before. A school full of asians and jews? Sounds great!

the thing is, even if you get rid of legacy admits AND AA, you still don't have a 'meritocracy' because some mystery factor is creating massive over representation of Jews even after controlling for test scores/IQ/population size. see: the notorious UNZ story documenting this.

the defense against eliminating legacy admits is that stanford is an elite university and there are factors that are more important that academics, like character, leadership ability, chads who come from long lines of prominent families who have served the country in high profile govt roles or have been generals or have succeeded in businesses to a really high degree, and that the potential of those students is worth far more than a superstudy who will get 1600 on the sats but otherwise has no civic or redeeming character or qualities

of course rationale works when you have noblesse oblige but those days have long since passed and every one of them are going to work for blackstone or whatever so this is a good thing overall

A few points on this:

1. Legacy admits were not really underqualified. On average i believe they had higher test scores. I have no problem with schools reducing the randomness of the admissions process for people who have a history with the school.

2. AA wasn't really a problem it was the magnitude of AA. People would've been okay if 1 out 4 asian kids with a 1500 SAT score got in while 4 out of 4 black kids did. The problem is when 1 out of 10 Asian kids with a 1500 get in and 4 out of 4 black kids with a 1200 get in.

3. Big donors obviously get in - I'm sorry this is America. You don't take $20 million from someone and then reject their grandkid if he's anywhere near the requirements. We learned from the celeb scandal this type of admissions requires millions - and you have to be a complete moron to think that the entire student body isn't better off having a billionaire's kid there.

4. The celeb scandal showed that these schools are way too MEROCRATIC for their own good. Why can't Lori Loughlin's kid get into USC just because she's Lori Loughlin's kid? She was hot and has 1 million followers on Instagram? You don't think there might be some benefits to having celeb kids in a school known for hits film school? Jonah Hill and i'm sure many others were discovered becase of their friends famous fathers.

You don't go to Stanford because of the lectures - you go there because its (i) signaling that you're smart and (ii) putting you into an elite network. AA killed (i), conversely this ruling would kill (ii).

What did it say exactly?

Admissions is stupid. MOST people would not get in via "merit' because the "merit" is the whims of the adcoms.

Do legacies have the SAT scores? If so, let them in.

The NOWAG lawsuit showed legacy admits were more qualified than a typical applicant. They just go in disproportionately.

Completely meaningless. The only thing that matters is how they compare to the typical acceptee, not applicant.

"just say it openly"

They put the family's name on the buildings asshat.

It takes in the millions to get someone in as a donor. If you're interested, i'm sure you can call them up to chat about it.

the point dumbass is that the bar to buy your way in is set so high to the point it doesn't affect the overall quality of the student population and it benefits the university by them getting donor $ and benefits the students because they have a rich idiot they can network with in their cohort.

Only childless people think this way. Donating and legacy admission is a means for (i) successful alumni to impart their lessons into an institution they feel a part of, and (ii) to further develop their own offspring with the lessons they have inculcated in them since birth, within a network of similarly successful families.

The pure “meritocracy” of test scores and GPAs has fallen victim to Goodhart’s law. College was never about finding the best test takers and giving them a degree.

Is there another developed country where children of donors get such naked preferential treatment in college admissions? Please let me know if you can name one.

Stanford will just ignore this law like all the other times schools ignored rulings on AA.

I don't think AA killed (i) in your scenario. The ivies, Stanford, UC schools, Mich, etc. were still sought after regardless of their AA policies. If AA killed (i) it would have created some incentive for schools to phase it out without being pressured to do so.

imagine the head of pr for stanford saying "we cant just take chinese kids who cheated on the sats because then no one will want to go to school here" it would be like if aaron rodgers had just come out and said "i didnt marry danica patrick bc shes a crusty old bitch and i didnt want to sign the damn legal documents" stuff like this has been so obvious for so long i cant believe you dorks are still bothering to debate it.

Stanford (and other public and private universities) used to have policies where the children of professors were autoadmits if they had semi-decent applications (LOL Kamala). Anyone know if they still have them or if this bill stomps that out?
