Tbh it works the opposite way. Plaintiffs aren’t really hurt and just go to lawyer first. And then the lawyer sends them to doctors to create damages. So it’s actually the doctors that want referrals from the PI attorneys. And they get the referrals by being willing to inflate damages

He directs his patients not to use health insurance. And then the treating providers in his network bill at a really high rate, hold the bill in abeyance pending case resolution. Then get reimbursed a high percentage of the billed rate at the time of the settlement. Docs fare significantly better than they would have under insurance reimbursement rates, and everyone is happy. None of that violates any ethics rules that I can think of.

The way to do it in California would be just to direct clients not to use their health insurance at all, honor the highest possible billing rate in reimbursement after cases settle. That's all. And there's nothing wrong with that per se.

What?? The medical services are billed at a high rate--as high as you can get without shutting the whole thing down--and then the bills are held in abeyance pending case resolution. It doesnt matter whether the patient has health insurance or not under that scenario--if he does, he just doesn't use it.

I dont understand, and again, it's not really a kickback. If the liens are higher than if he went elsewhere for treatment, but the settlement (which is driven in part by the extent of medical bills) is also higher as a result, the client ends up putting *more* in his pocket than he would otherwise.
The amount of the bills to some extent drives the value of the case.

And you can thank the auto insurance company for only looking at medical bills when determining what to pay for a claim and using that as their primary basis for calculating a number.
So clients who treat through Medi-Cal get paid less generally than clients who treat on lien all things being equal. You can blame the insurance companies for that, not Plaintiff's attorneys.

Settlements should account for future pain and suffering and future medical expenses though. A settlement is not just over the medical liens. And the greater the liens the larger the future P&S.
You could have a $1000 lien and $10,000 in future P&S or a $10,000 lien and $20,000 in future P&S and the client comes out ahead.
