The argument would be (and a strong one at that), that the court does not have the jurisdiction to grant a DVTRO against the petitioner unless the respondent filed a competing one. In theory, a judge could sua sponte grant a DVRO under those circumstances, but in 23 years practicing I've never seen it and my intuition is that CSLG is not telling the truth.
