The primary reason is that the law insists a woman who signs is not giving up rights that she doesn't know about. That is why, for example, full disclosure of assets is required. But what about rights to what the man will build or earn after the prenup is signed? You and i would think "well youre signing away rights to whatever may be built, and you acknowledge that of course you cannot know specifically what that will be. But you can sign it away anyway." But the way the judge looks at it, since they dont respect the rights of parties to contract, is "since she did not know that he would make millions, how could she sign it away?" Fucked up but basically very illuminating- the state does not respect the rights of individuals to contract. That's why CSLGs proclamation of his "ironclad" prenup was always silly |

No idea how this works for CA, but in NJ for example, you can certainly designate assets acquired during the marriage as separate property not subject to equitable distribution.

i have a friend in CA who got a divorce. no kids, no significant wealth (a house and some retirement money), no prenup and he got fucked. had to pay her alimony bc shes a loser with a loser job. he's a grip and makes like 160-180k a year, so he isn't rich by any means. i have to imagine CA is hard on wealthy doods who get divorced.
