why the fuck can't Congress regulate citizenship in those cases? Roberts says it's because in feudal Europe those born on the soil belong to the king of that soil. ok, i guess. but the US Constitution gives Congress all sorts of democratic powers over nationalization and citizenship. the democratic solution is to acknowledge that Congress can act in these marginal cases and at the same time insist that Congress cannot deprive former slaves and their descendants of their citizenship. |

Also at the time of 14A, literally no one thought that Native Americans were citizens. Not one. So there were people in America who were not citizens. They were born here but they were considered aliens. Some Nigerian lady gets off a plane, no connection to this country? Should not be a citizen. |
