They'll leave it 'open' by deciding that Congress intended to incorporate the public understanding of jurisdiction at the time into the 1957 Immigration and Nationality Act while deftly avoiding the constitutional issue. Then if Congress ever does promulgate a new definition of jurisdiction they'll just refuse certiorari on the circuit affirmance of the classwide injunction. If the 5th Circuit decides otherwise they'll find a procedural fault and remand with instructions over and over until they have to confront the question, at which point they'll decide that the historical authorities differ too much and there's too many reliance interests and administrability concerns and so they'll reverse in full. This will take 20 years, on top of the 30 other years that have already been sunk into this Quixotic dream, and you and Kris Kobach will have endured the worst case of blue balls in history for nothing. Less than nothing; there will be millions of birthright citizens who know they will never be safe unless they make people like you politically irrelevant.

Afroyim v Rusk relies on the idea that Congress has no enumerated power to rescind citizenship. A sufficiently politically motivated court could reverse course and say that the power to grant is the power to rescind (if you want, qualify it with 'when granted on the basis of a mistake'). Of course there are a million arguments against this, and of course it will never happen.

It's a good question, isn't it? The current situation is pretty easy to administer; if you have a birth certificate showing birth here, you're a citizen and can get a passport.

I suppose you could have some separate process, where we create an agency tasked with registering citizenship for new babbies, but this would be a huge undertaking -- you'd need new offices in thousands of cities and towns, and probably at least half of proles would never bother with taking their babby to register him/her/they.

this is such a spurious and bad faith concern considering most countries do not have birthright citizenship and manage to administer it without the type of system you're saying would be necessary.

I would assume that in countries that don't have birthright citizenship, you would have to show evidence that your parents are citizens when you apply for a passport or do something else that requires proof of citizenship. But I have never looked into it. Regardless, they make this work in most of Europe, so I assume it is not an insurmountable obstacle.

And so if the parents are not citizens, what then? No birth certificate is issued?

Look, they make this work in Europe, so it's clearly not an insurmountable obstacle. But maybe you should think five minutes about how it will work before you start mocking EPAH. I was born in Germany because my parents were in the military. I have a German birth certificate. I am not a German citizen, though, because there is no birthright citizenship in Germany. I don't know how you prove citizenship in a jus sanguinis country, but it's not by denying birth certificates to people who are born to non-citizens.

however countries without birthright citizenship do it, which includes nearly the nearly all western countries with aystems similar to ours.

cmon man, i don't have to know exactly how it works to know its possible, i just need to see that it already exists. you cant explain rocket science to me but you know rockets exist right?

And I'm guessing that all of those countries have a much more thoroughly integrated national government in place -- for example, one that runs their hospitals where the babies are born.

But let's go back to whether KJ's question was stupid, as so many 100-110IQ posters seem to conclude. If you were the administration or the SG who had developed this proposal, do you think it'd be ridiculous to simultaneously conceive of a plan for how it would be implemented? Or would you just say, "Starting today this is the New Law. No idea how to Implement this, but I just need to see that it already Exists to know that We can do it."

please. i dont treat you like obeezy and i wish you would do me the respect of not treating me like retarded cons here. you know that the majority of countries do not have birthright which includes many that do not have government run healthcare.

no, i dont think the court needs to weigh in on enforcement. the court decides what the law is. they could decide birthright isn't a constitutional right and a future administration could stop deporting non-citizens. no law could ever be enforced perfectly anyway, it's up to other branches to decide how much effort and money to spend on it. not every murder will be solved, yet we still prohibit murder.

you're right that it will be very difficult to administer perfectly and a lot of kids will become citizens when they shouldn't have. something being difficult to enforce has no impact on whether it should be legal. you and i do illegal things every day like speeding. the fact speeding can not bebperfectly enforced doesnt mean it should be legal to drive at any speed.

also when it comes to interpreting the constitution enforcement has 0% to so with it. if the constitution says the government must provide me with five wives, the fact that it's impossible for every man to have five wives doesn't change what it says. it's not the province of the courts to opine on the wisdom of the law.

SCOTUS routinely considers the practical consequences of its constitutional rulings, bud. See the gay marriage case and the abortion case for two recent examples.

And this isn't strictly a "the Constitution says" case. It's about whether POTUS has the authority to make this rule. If it were purely constitutional, it wouldn't be applied only prospectively, as that dude with the raspy voice explained. So if you're taking this case to SCOTUS, you obviously need to be prepared to field that question.

And I agree that it's logistically possible if we're willing to create the bureaucracy to implement it.

But I suppose it should be the proponents' task to say, "here's the proposal, and here's how we are going to implement it."

its the same process for me since my kids were born outside of the US.

In the US, the hospital fills out and applies for your SSN, registers your birth cert. If born outside the US, you just fill out a form and apply for a SSN and citizenship for your kid. Once obtained, its considered to be obtained since birth.

Are you really retarded? Just apply for a SSN, passport, etc . We do it all the time for Americans born abroad.

It's simple to implement. If you don't have proof of citizenship, the hospital issues a temporary certificate of live birth for the mother to use at her local consulate/embassy. If she's here illegally, then she and her baby get booted.

Citizenship can only be established at the time of birth if the mother provides proof of citizenship (birth certificate or passport). It's just like paternity, which can only be confirmed at the time of birth by a blood sample from the putative father(s).

Correct, this is going forward.

Retroactive citizenship denial (aka citizenship revocation) is extremely difficult because it involves the "true" country of citizenship's cooperation. You can't have people just become stateless.

A more rational approach would be to audit the birth records and cross-reference the data with immigration records (e.g., entry/exit times + country of citizenship) + social security records and SSS records. Start with those who haven't registered for the SSS within 30 days of their 18th birthday.

dude, if there is going to be a cut out for legal immigrants who are applying to become us citizens and ultimately do become legal citizens, i'm sure something can be done about their babies.

but, i have no problem making their babies citizens of their home countries even after mommy and daddy become us citizens. hold off having your kids, bitches.

anyway, under what you are saying...prove your status even if it's not us citizenship and maybe those kids could be us citizens.

yeah, no

the allegiance for the baby would occur when baby's parents' application to become citizens is approved, not before

And how exactly do they decide if you get to check that box? If you forget your birth certificate when you rush to the hospital to have your baby, then your baby gets put on the next flight to Mexico even if both parents have lived in the U.S. since the 1700's? Maybe you shouldn't be pounding your chest about how this is such an easy problem to solve when you clearly haven't thought about it for more than 30 seconds.

Moreover, without birthright citizenship it will be difficult for anyone who isn't a recently arrived immigrant to establish their citizenship. There are many presumptive Americans who, for various reasons, have no immigration or naturalization records in their families. Unless you want to deport the children of the Founding Fathers, you have to have birthright citizenship for some generation in the past, you can't totally get rid of it.

why would it be any harder to establish whether someone here is a citizen that doesn't have birth records? if a birth certificate doesn't establish citizenship it's the same trying to figure out whether a person with no records is an illegal.

a lot of people are getting stuck on how this is impossible to prove conclusively. but almost nothing is able to be proved conclusively! we have an income tax system even though its impossible to be certain a person has reported all their income.

the government already has to meet a very high burden when challenging if someone obtained their citizenship legally. people claiming birthright citizenship would be protected by that same high standard. yeah, a lot of people will get off when they shouldn't, and sadly some innocents may be punished unjustly, but that is the case with almost every law!

EPAH is a dumb fuck. Depending on what part of the country you are in and have been for a while, estimates at stores, public places, DL office, etc. offer good common sense data.

BUT if you want 'so we looked at the data' evidence, just compare the rates of change in public school systems. For example like in Ector County, Texas (Odessa). When the book Friday Night Lights came out in 1988-1989, Ector County ISD was like 30-35% Hispanic. Now it is 82.2% Hispanic.

The thing with public school data is that it shows the future without the spin. Every public school wants mo money fo dem programs and will religiously count every head and document the data.

Additionally, all you have to do is check demographics vs school data for % below poverty line (ie., qualify for free lunch). For example, you will see a majority in the case of Ector County, 71.5% claim to quality for free lunch. Now this is in a part of the country where any able bodied man can get a job in the oilfield paying 70-100K annually without a high school diploma. Near 3/4 apparently are growing up below the poverty line but if you were to drive over there, you'd see 50K plus vehicles are a dime a dozen. It's all fraud lies and cream pies and a sham. They have sucked USA dry.

nigger you cant observe whether someone is illegal by looking at them. i am aware of shifting demographics and my stance on immigration is informed by that. the fact that many of them became citizens through shit like birthright and other policies that i think should be eliminated doesn't change the fact that they *ARE* citizens.

i swear, you retards have an impossible time understanding the difference between acknowledging a fact you wish was untrue versus believing it is a fact because you wish it was true. and that embellishing things doesn't persuade people, it does the opposite by eviscerating your credibility. if you honestly think 25% of people here are illegal immigrants because there are a lot of spics in los angeles (gee, why does that city have a hispanic name) you're retarded. 25% is a huge number.

I had written “there are probably somewhere between 50-100 million illegals and children of illegals in the country, maybe more”

Children of illegals in the country = legal “citizens” due to birthright citizenship, relevant to the topic at hand

Put down the tutu and please read my comments with more care in the future, this is like the 4th time you have embarrassed yourself

You literally cannot be this fucking stupid.

Although its hard to purse the data since Hispanic was not a category in USA census data prior to 1970, if you go back to 1970, Texas was about 17% Hispanic. Now its 53.1% Hispanic enrollment in Texas public schools.

gunnerattt literally does not believe anything unless officially sanctioned experts tell him it is real, and he is unwilling to tie official data into an unsanctioned narrative. he is apparently concerned about the chaos that would ensue without "trusting the experts", so it is a hard line for him that he will not cross

once one understands and accepts this about him then he becomes easier to engage with

All of them.

Between 1892 and 1924, all of it was legal so long as you passed through Ellis Island. Prior to 1890, the federal government didn't handle immigration (although it was still mostly through Ellis Island).

The Immigration Act of 1924 curtailed the flow significantly.

No. "under US jurisdiction" is extremely broad and basically covers virtually everyone stepping foot in the country, including those who have far more limited rights, including the right to vote. You keep looking at it backwards. The rule is "everyone is subject to US jurisdiction and here are a couple of extremely narrow exceptions (diplomats, natives in tribe that has treaty with US etc.)"

Don't know why people expected anything else. The Court has its hands tied as birthright citizenship is guaranteed by the Constitution via either then 13th or 14th amendment. Logically, the arguments against it is correct, very few other countries have such a provision and people abuse it, and it was added to the Constitution solely to address the issue of freed slaves. But the Court is a stickler when it comes to the Constitution and I don't doubt individual judges are sympathetic to the logical argument for ending birthright citizenship, but it can only be undone through an amendment undoing it. And good luck with that.

The only good thing to come out of this case is watching Jackson exposing herself as the greatest midwit to ever sit on the Court.

It entirely is a joke. It is always political and acting like it isn't is a farce. There is a reason this form of judicial review we have now was NOT included in the Constitution.

most of conlaw is a joke because of all the judge-made penumbra shit they invented to get to an outcome they prefer for political reasons. this is the exact opposite. im sure the conservative majority would prefer to end birthright citizenship, but won't ignore the clear language.

and wtf do you mean this wasnt anticipated by the constitution? how about art 3 establishing a federal judiciary? what would is purpose of it if not to resolve cases and controversies involving federal law? if marbury was a huge overreach they would have changed things. madison, the father of the constitution, was a party in the fucking case!!

lib argument: BRC is absolute by its text. no exceptions.

counter: we literally know that's wrong. several categories of people do not get BRC.

libs reply: yes those categories are exception but besides the exceptions the rule admits no exceptions.

counter sur-rebutal: no, the phrase admits exceptions and given Congress's many express powers over borders and citizenship they can make exceptions for children of illegal aliens.

My understanding of the arguments being made for BRC is that the constitution provides it for those born in the US, with some exclusions, for example Indians and Ambassadors.

Congress can expand those who receive citizenship, but it cannot restrict it beyond the exclusions already included in the constitution.

I guess it's cool if she thinks so, but it doesn't help in this case, because Congress isnt going to do shit.

a number of scholars have written what strike me as convincing arguments that Congress can make more negative exceptions related to jurisdiction. Schuck, Wurnam, and others have written about that.

admittedly from the oral argument i'd say the argument is very unlikely to succeed.
