Benjamin posted the following in a newspaper of general circulation on Monday:

Benjamin hereby offers to pay 5,000 pounds to anyone who provides Benjamin in person with satisfactory proof of Roe’s true identity.

A private detective named Holmes read of the offer and immediately got on the case. He spent the next 48 hours doing everything he could to find Roe’s true identity.

On the Friday afternoon after the offer he obtained the proof that Roe’s real name was Joe. He made an appointment with Benjamin that evening at 6:00 pm to provide his proof and collect the reward.

However, Joe had a 5:00 pm appointment that same day, at which she confessed to Benjamin that he was Roe.

Holmes met with Benjamin at 6:00 pm and offered his proof. He listened quietly before congratulating Holmes on his powers of deduction, but also told him that he was too late, as the offer was no longer open.

Benjamin is not liable to Holmes. Why?

A) Because the offer lapsed before he could perform.

B) Because Benjamin's posting was an advertisement and hence only an invitation to bargain.

But see Restatement of Contracts 2d section 46: Where an offer is made by advertisement in a newspaper or other general notification to the public or to a number of persons whose identity is unknown to the offeror, the offeree's power of acceptance is terminated when a notice of termination is given publicity by advertisement or other general notification equal to that given to the offer and no better means of notification is reasonably available.

It seems that no general notification equal to that given to the offer was given here, nor any other means. Rather, Ben waited until Holmes performed before providing notice.
