Where they were headed is irrelevant if we're in an armed conflict and they're members who carry out continuous combat function within that drug trafficking organization. The law treats them like ordinary members of state armed forces. You can kill them anywhere. It's irrelevant if they're carrying weapons or asleep in their barracks or taking a shit. Only time you can't, maybe, target them is when they're on leave from combat away from theatre but that's not really actually true especially in NIAC against non state armed groups. The only thing relevant to the war crime aspect is if the guys were incapable of continuing to "fight" but again this is grey because continuous combat function that way. It's like a soldier dropping their arms and running from artillery. At that moment there's nothing to stop any belligerent actor from continuing to target them because there's no reason to think they won't, and in reality will, regroup with the enemy military and continue to fight. Doesnt help that shipwrecked are literal paradigm examples in hundreds of military manuals for people you can't target but the context of that was meant to be in naval engagements where the winners boat is circling a downed enemy vessel and guys are flailing around so sailors don't just shoot at them. The world we're in is different now and even with those examples at least the US makes clear that they actually need to be incapable of fighting even when shipwrecked to have hors de combat protection.
If we're not in an armed conflict it doesn't matter because 18 USC 1111 isn't extraterritorial and we don't know if it can apply to executive action anyways, you'll get hundreds or really 2 opinions on that question. |

Even direct military intervention isn't effective in the long-term; in countries that supply illicit drugs, drug trafficking is a cornerstone of the economy and political system. Take down one cartel, and a new one inevitably pops up. Kick out one corrupt politician, and a new one becomes corrupt eventually. It's simply impossible to stop the flow of drugs into the country for multiple reasons: it's easy to get drugs across the border, there's a lot of money in it, and there will always be demand. |
