The $100k fee doesn't apply to those already in US on student visas.
"The proposed $100,000 fee applicable to H-1B applicants from outside the US is expected to further suppress volumes. While it does not apply to candidates already in the US on F-1, H-4 or L-1 visas, it indicates the need for greater caution overall."
