Why midnight? Assume you don't have a reason to think the people waiting on the draft are going to do another turn in the wee hours of the morning. So, at that point, what's the differences with doing (and billing for) a few more hours and sending it at 3 am?

And at that point, what's the difference with waiting to send it at 7 or 8 am, before the next workday starts?

Court filing is easy insofar as there will be a Local Rule.

For other work, I don't want to scramble to get things done by 2 pm--especially because it means I might get the next round of comments back the same day. I want to chill while things build up throughout the day, then scramble through several things between about 4:30 and 5:20.

Biglaw trannies are also midnight, but 10 pm is far more appreciated because it lets others bill easy hours before bed. Inhouse 2 pm is only west coast with east coast audience but most people specify “COB” and that means get it out by 4 your time so others have the option of reviewing before they leave to pick up their kids or after they put their kids to bed (they won’t actually review or respond for at least a week).

Setting an artificial 4 pm deadline is wild. If someone wants to review it that day, they should say so and specify a time. People get jammed up with meetings, multiple agreements to review, poasts to make, etc.

Absolutely CR re "they won’t actually review or respond for at least a week," btw. There are two times for responses--5 minutes after you send and late next week.

Yes. The point of the 4 pm deadline is for them to pretend that they are hardworking and for you to pass your own self-imposed shit test. But the logic of this makes sense the more exposure you have to senior execs/SVPs and other managers of managers who are running large organizations. Most of what they do is at least partially performative.

Why those times? At 9, I might just be logging back on after the kids go to bed. So, getting the draft out before I go to bed matches the EOD and my schedule better.

It generally means 5 or 6pm in the requestor’s time zone if the person is either important or a client. In other cases it means before they log on the next morning.

Worst thing you can do is send it early enough to get comments back that night, after you’ve rushed to get it out, screwed off online for 90 mins to recuperate, and finally turned to the other work you were supposed to get done yesterday/today/last week.

In either of those cases, it should mean before they log on the next morning.

More precisely in biglaw, end of day means “before you go to bed and before I wake up.” But you better gird your ass if you misjudge that and get a “Where is the draft?” at 4 am.
