Illegals are subject to the jurisdiction of the US and that is the way the amendment was drafted unfortunately.
Even Thomas basically conceded that anyone domiciled in the US was subject to the jurisdiction of the US.
Travelers is more contentious and less defensible but this is a drop in the bucket in the grand scheme of things

Just define it as whether you have indefinite leave to REMAIN, which is how I assume it’s basically done in every other country in the world.

Mark Levin has gone full Israel shill, but there was a point where he was pushing for a Convention of States to amend the constitution. Maybe it's impossible, but it always seemed like the only actual method for amending the constitution in any useful way.
It feels like this is off the table now and probably needed to get done in like 2010 at the latest. (Around when the idea was being discussed by Levin and others.)
Again, I realize Levin is full bore Israel first at this point, but the Convention of States idea felt like a strong approach.

It depends on what the meaning of the word "Jurisdiction" is.
Now, that may sound like a lawyer’s answer, but the Constitution is a lawyer’s document. If jurisdiction means the power of the United States to enforce its laws, then the child is under our jurisdiction. The parents can be arrested, sued, taxed, deported, and held accountable under American law. They are not diplomats. They are not an invading army. They are here, and the law reaches them.
But if jurisdiction means full political allegiance, as in a deeper belonging to the American community, then the question gets harder. A tourist obeys our laws, but he has not joined our country. An undocumented immigrant is subject to our authority, but he has not been admitted into our polity.
I think we ought to be very careful before letting the government decide that some children born here are less “born here” than others. And we ought to be just as careful before saying the government has no choice to make at all.
