What was he doing beforehand? Bear in mind unique facts (even if not remotely compelling) mean you lose on QI. Especially in the Fifth.
But the bigger problem will be damages. I almost exclusively take wrongful deaths and maybe 1 (coma, PVS) or 2 (permanent paralysis, loss of limb) steps down. Don't get me wrong, I'm sure you can get some expert to say he has TBI, but jurors will be rightly skeptical. Guy's also going to pick up 2-4 more arrests between now and trial, which jury won't like (another benefit of only representing estates, tbh; if this had killed him, you could say he was within months of being an airline pilot).
