My zany idea is that you argue that winning a POTUS election absolves you of all crimes or at least any consequences of it during your term in office.

Sentencing postponed to no earlier than January 21, 2029. Appeals can proceed on consent of POTUS, otherwise stayed until that date.

the legal theory was even more convoluted and fucked up than the civil fraud theory. and the appellate court sounded severely skeptical about the civil fraud case.

It would get overturned either on raiding an attorneys office to get evidence against a defendant on an unrelated matter OR letting a state jury use that evidence to enhance a misdemeanor to a felony for a federal election violation that he was never convicted on and the jury just says "mmmm hmmm, yeah that man guilty, I've seen all I need to see, baby 💅."

the theory of the case is that his fraudulent representations become felonies and can be prosecuted at all because they were in service of an underlying federal felony that he has never been charged with, like 8 things are weird about that

you can just picture Eisen and Weissman spending countless hours trying to come up with the theory.

He can't be sentenced while in office. SCOTUS clearly won't permit that.
