A friend settled a YUGE PI case a few weeks ago.

Attorney fee is gonna be about $300k.

Friend doesn't want to transfer the funds to until 2026 to avoid the tax hit.

IIRC tax hits when it settled, like when settlement agerment signed or judgment issued. it doesnt matter when he cashes actual check. but as a practical matter u really think the IRS is gonna give a furk as long as he ends up paying the tax

a better tax question is if the full settlement is just on one check and he deposited it into his IOLTA account, then he waited to write the check for his fees until next year

in that case maybe its diff though i dont think so cause pretty sure IRS views it as taxable in the year settlement signed

but again, furk this shit nigga, IRS isnt gonna do shit as long as he ultimately reports it and pays whatever taxes
