The Real Rate Report that Wolters Klewer puts out. We've had several courts say that we should get the third quartile for shitigation partners at national firms, so we usually just propose that.

In this last one we proposed the 3Q rate for antitrust litigation, but our kindly judge said that we can't have that much because we don't have the same overhead expenses as Latham and O'Melveny do. A very weird rationale for what the reasonable rate is for performing similar work, even beyond the fact that I'm the singular authority in the country on RPA litigation. Anyway, so we're gonna appeal the shit out of that, and ideally get back up to $1320 or so for antitrust work.

Our discovery in a different case there showed that the plaintiff in that dispute was charging different prices to different customers. It was completely unrelated to the dispute, but a boomer partner said to me, "did you know that's against the law?" I was like, "bullshit," and he said "you ever hear tell of the RPA?"

After reading a few cases I was like fuck, a guy could make a killing with these cases. So then I spent every commute for the next six months reading every RPA case, and approached a LS classmate with the biz plan, and that's how we got started.

Actually the company that we had represented in the unrelated case at my old firm was naturally pissed at that mfr plaintiff, so after we started our firm I just called up one of the owners and was like, "let's go after these fuckers for their RPA violation." That case settled for a lot, and then he referred me to other similar businesses.

I might fully retire before 20 years, but I suppose we'll keep doing them until SCOTUS holds that corporations have a right to do whatever they want.

We've talked off and on about adding people, but have been able to handle what we need so far.

Extremely easy for me. You look at the sell price at Costco, and subtract 13% to learn its acquisition cost. Then you ask your clients what their acquisition cost is.

so costco price - .13(costco price) = their wholesale acquisition cost for whatever acme widget they're selling

then, you just sashay into other retailers like they're a dick pill bodega and ask them what their wholesale cost is?

then, if they say it's higher you educate them on their legal options?

is this why costco has their 'made for costco' models that have slightly different sku #'s and tweaked features (e.g. removing an hdmi port off a tv) to provide defensibility?

1. Yeah they have a very standard 13-14% markup (whatever rounds to $x.99. But we take it to our harem of existing clients rather than to some randos. The plaintiff has to do a lot of volume to make the damage$ worth it.

2. That's a big reason why. I'd actually like to challenge this in the right case, b/c just switching the branding of a product doesn't remove it from the RPA's scope. The question is only whether the product is of "like grade and quality." So I'd kinda like to sue a supplier that just makes a Kirkland brand that's identical to the name brand, but sells it to Costco for 2/3 the price.
