They claimed Lindsay was a monster and an evil manipulator. Everyone in her life's testified that she was an amazing person and everyone loved her. They claimed she faked her suicide. Turns out she transected two vertebrae and coded in the hospital twice. They claimed she was not suffering from a mental disease or defect. Every psychiatric witness on both sides agreed she did.

On balance Lindsay was a kind caring person living a normal life who had a psychotic break with reality, reached out to a dozen healthcare providers, was given SSRIs when it was known she had bipolar which can really mess someone up. She was denied entry into multiple mental health facilities because she never explicitly stated she had a plan to kill herself and there was a ton of evidence that she was hiding the severity of her condition so people wouldn't take her kids away. Testimony came out that still to this day Lindsay downplays her condition when shrinks interview her. The prosecution expert also agreed with the defense theory that Lindsay believed in her delusional mind that she had to kill the kids before she killed herself so they would be protected in heaven. Another prosecution expert testified that the prosecution theory 'downplayed' what Lindsay went through.

There is really only one steel man argument for guilt here. And that is that it took a lot of planning for her to kill the kids. The prosecution theory is that no one who is psychotic could pull off what she did which was fairly technical, elaborate, and cruel. So yeah theoretically some jurors could be really dug in on guilt if they buy that it's impossible to be psychotic and do a triple homicide with a lot of premeditation. Most of the prosecution testimony was hammering home the cruelty of the crime. They harped on emotion and brow beat the jury by constantly reminding them how bad the murders were. They didn't pound on the evidence in the case, they pounded on emotion.

The defense also had Dr. Reznik who is the absolute leader in the world in the field of criminal psychiatry, so much so that the prosecution experts had to rely on his research.

The only case for conviction is if you are extremely dug in on premeditation and can't get past the cruelty and evil of the crime. But aside from that none of the actual evidence is on the prosecution side. Lindsay was a normal person who went completely insane in 4 months, reached out for help, and was given shit care by a number of truly inept retarded birdbrain doctors. I also think on a personal note that her husband was a huge pussy.

If it is a mistrial and I'm the DA, I'm looking to offer her a plea to the material facts and to offer her commitment to the state mental hospital. That avoids being the guy who makes all these first responders testify again in a month long horrifying trial.

I would think that the voters in Plymouth County would prefer they didn't go through all of this again. Especially when poll after poll shows about 2/3rds of respondents think she's NGRI and only 10-20% think she's guilty. The most likely result of retrial is another mistrial. This is yellow/blue dress territory.
