second, the current process of kicking the can down the road -- continuing resolutions -- can be blocked by either party at will because of the Senate filibuster threshold requiring 60 senators.

the reason scotus has expanded potus power is because the legislature ain't doing shit. all the decisions which bless potus expanding power is based on congress delegating or authorizing it in some way. and scotus hates blessing that too (e.g. EOs that got overturned still have majority congressional support usually, but not enough to get past filibuster.)

in a situation where congress *is* passing law and potus is trying to EO his way around it, scotus would have nothing to rely on to side with potus. and the sitting scotus wouldn't want to anyway. and thats cons, libs hate powerful potus even more. so there's really no scenario i can imagine where scotus starts saying potus = power to legislate.
