In a minority of jurisdictions, you can subpoena the third party communications provider to get the texts/emails directly. And I have even heard that a few rogue judges have granted sanctions when those third party productions were inconsistent with what the party produced, sometimes even allowing direct access to data cloned from the party's devices. But again, these are minority jurisdictions and rogue judges doing this. |
