Once this one got to trial, they should have changed their tune. Rowley's point about Starbucks saying it's policy is it doesn't matter what happens after they hand a customer the drink was either a lie by Rowley (that the defense should have objected to) or a huge misstep by Starbucks. |

Unless they have video evidence of the employee handing him the thing without pressing it all the way in, it's a he-said she-said.
Now imagine Starbucks being like yeah once we pass off our drinks to the customer even if an hour later they reheat it on the stove and burn themselves doing something stupid, it's on us!
We have no idea what the material facts are and never will. Some guy spilled a hot drink on himself and it happened at a Starbucks location. Sucks for Starbucks, they were going down no matter what. But I can see some lawyers shrugging and going how the fuck is this our fault.
It's the job of Rowley types to nail these guys to the cross because it's financially beneficial to them to do so. They get paid enormous sums to make Fortune 500 companies look bad. That's all it is, it's just a game to these people. |

My guess is the defense firm made mid 6 to 7 figures on this case in fees. The other thing is that a company like this gets sued thousands of times per year. Defense lawyers and corporations have no idea how to value a case and don't understand that juries will award huge amounts of money in cases like this. It was a BS low value case. I tell him we're about to do closings and he goes "let me do it." lmao. he was ready to come do a closing argument on a BS fender bender low value claim because he genuinely wants to fuck insurance companies and create chaos.

But the big difference between the top trial guys and normal trial guys is honestly just hard work and good prep. Nick knows EVERYTHING about the case. Every deposition, every opinion, every piece of evidence, the background of every expert, etc. So if someone misspeaks, exaggerates, or lies, Nick destroys them. He also has a team of like 6 lawyers that pump out stuff none stop. High quality videos, well prepared questions, etc. On top of that, they hire jury consultants, and do mock openings and closings to gauge value on cases.
