Assuming the contract is reasonably drafted and he's covered by the primary term (not the covenant not to compete afterwards) he has zero options that do not expose him to catastrophic litigation.
The language in the contract is likely broad enough to cover whatever they want it to (during the primary term). He has probably consented to a jurisdiction where this is specifically enforceable.
He can take a risk and make a political decision that Fox will not take legal action because of appearances (what his Twitter show was probably banking on) but that is not a legal consideration.
Legally he is fucked.
After the primary term if there is an extended CNC after compensation ends enforceability is much dicier. I do not have multi-state experience with CNCs but would assume this period cannot extend more than 2-3 years in any case.
bottom line: His twitter show absolutely can be competition even if unpaid. And, during his primary term (while Fox pays him) he's hooked.

There appears to be a contingent on XO that sincerely believes that no matter what, courts will strictly interpret and enforce EXTREMELY broad and long non-compete agreements -- right up to and perhaps including throwing someone in jail for not complying with a court order issued to enforce them which forbids a person from publicly sharing their own personal opinions on important political issues of the day (if that's what the noncompete ostensibly says they can't do) in the lead up to a presidential election year -- because noncompetes are ironclad legal chains that trump all other considerations in the world, and if it says X in the contract, then judges have absolutely no ability to ever refuse to enforce X or limit the enforcement or X or curtail the reach of X or judicially modify what X says or...
Then there are people on XO who think that in the real world, courts regularly strike down, or, if they do enforce them, judicially modify noncompete clauses that they find to be unduly broad or burdensome or long in duration when weighed against a whole host of other considerations (public interest, etc.), and that realistically in any event the *actual* practical recourse for a company that seeks to enforce a noncompete against an employee who is being given a bunch of money to sit at home and refrain from sharing his own personal political opinions online is the mere forfeiture of that money (and possibly repayment of any of it that has already been paid out), rather than sending the guy to jail for "contempt" if he continues to share his personal views on political issues online in the year leading up to a presidential election.
IMO it's very hard to figure out which group is correct and has a good grasp of the world, and which group is totally fucking retarded and has not idea what it's talking about. We'll just have to wait and see!

...and then, if and when I violate that provision of my private contract by publicly sharing my thoughts on political issues, not only will an American court actually issue an ordering legally requiring me to shut the fuck up and refrain from publicly commenting on any political issues for the duration of the term (instead of just saying "OK you violated the contract so you have to pay the money back")...
...but I will literally be sent to *jail* by that very same court if I refuse to comply with the court order and instead continue to publicly share my personal views on political issues?
(And of course if this did happen, it would all be upheld on appeal by yet another court while I rot in jail for publicly speaking my mind about political issues, because that's just how this shit works?)
