Even a negative opinion is legal) would have to be said; then it would have to be proven over 50% likelihood (the civil liability standard- preponderance of evidence) that it actually was spoken. Where is your evidence? Non-consenting mp3 recording? The liability is way overexaggerated but there's anyway 0 upside to talking shit about a former employee- if anything, please hire this retard! An anecdote--At a former job I had, our online application form required candidates to enter 3 references when applying. But, we never called those references. (A seperate, third party background check company confirmed degrees and dates of employment.) I kept telling them we were losing good candidates because people didn't want to list 3 references, especially at that early stage of the process, and it was especially foolish because we didn't even call those references. It never changed. |
