At least one of them is getting shitloads of free press lately and has grown a lot in the last few years. However all of these lawyers are only doing VICP litigation. They never take a claim to state or federal district court, and might be committing malpractice if they even tried to. Among other things the law requires the lawyer to inform the client about the VICP and the potential damages he can get through the program. Are you going to say "but I recommend skipping all that and taking an untested approach that's likely to lose at trial and will require SCOTUS to overturn?"
I've looked into the feasibility of challenging VICP/PREP Act on 7A grounds, but the case would have to be worked from the ground up as impact litigation. You would need a client who's willing to be an activist and you need expert witnesses. Lawyers would have to do it pro bono or have a nonprofit backing them. If anyone can land a client who's willing go full Rosa Parks, I know at least two people who probably meet the Daubert standard and would be happy to testify, probably for free. |

But yes it's around $5bn and that's not counting any of the COVID-related payouts. If you want to get into COVID payouts it's a little more complicated because they cover a lot more than vaccines. They can cover injuries caused by ventilators and other "emergency countermeasures." They are paying out claims for myocarditis and a few other vaxx complications but it's a pretty limited scope. Most people who had side effects never went to the doctor, or their prior medical records are too scarce or ambiguous to establish causation. It seems what's happened is the program administrators drew up a list of known side effects, and people who can prove they had a side effect on the list get compensated. So myocarditis is in because it's a well documented side effect, and because so many people with chest pain go to the doctor, those claims make up the bulk of the payouts on the COVID vaxx.
Also, AFAIK CoFC isn't paying out on side effects that occurred more than 14 days after injection. It's just assumed that any side effects from a vaccine must occur shortly after you get vaccinated. No one wants it on record that vaccines can have more nebulous long term effects. |

There are sound theoretical reasons to suspect it, and there's peer reviewed scientific literature you can bring into the discussion.
For example you can show that the same mechanism of action [claimed to be] at work in the vaccine is known to cause lesions in lab monkeys. When you're transfecting monkeys with RNA to examine their brains, you want to do it to your oldest monkeys, and you want to examine their brains within a narrow window of time, because by about six weeks after transfection they will develop lesions that interfere with your measurements. A good expert witness might have conducted such studies. He may be the one who proposed that they use the oldest monkeys, the ones who were already closest to death, because you can expect transfection to shorten the lifespan of a younger monkey, and monkeys are expensive. Make HHS rebut that.
You can also show that while the risk of autoimmunity may be acceptably low if you only get vaxxed once or twice, your risk of developing autoimmunity increases each time you get another dose. Each booster is another punch to your immune system, and the antigens are being produced by your own cells, so it's not far fetched to think your immune system might get confused and start attacking healthy tissue. Make CoFC tell you that's not a viable theory of liability. Or let them concede that it IS viable and get your client paid. NOW you've got a book of business. |

What they did instead was lobby Congress circa 2005 to strip all state and federal district courts of SMJ to hear any claim alleging vaccine injury. Simultaneously, they set up a taxpayer-funded slush fund and created an administrative procedure for bringing claims alleging vaccine injury. So people are getting paid, but not by Pfizer. And as long as they are getting paid, they lack standing to challenge the 2005 jurisdiction stripping law and vindicate their right to sue Pfizer.
Furthermore, lawyers who take vaccine injury cases are required by federal law to inform the client about the vaccine injury compensation program, and how much they can collect if they win. The vaccine injury court also guarantees payment of legal fees by any claimant, regardless of the outcome of their claim. So as a lawyer you have every incentive to take all your clients through the program. You have no reason, and perhaps no practical ability to sue Pfizer. If you take a claim to federal court you might be accused of malpractice, because the law tells lawyers to take these claims through the compensation fund. |
