"Well over a year ago i settled a case on behalf of a mom and a kid against USPS. The moms case was good, and the US atty paid. I settled the kids case too, for basically nothing as there were not even medical bills, for like $400"

"Good job, oh i know that US atty"

"Well bookkkeeping just told me that they never received the $400 from the kids settlement. And the SOL has run. And you know how soandso gets when we have fuck ups like this, regardless of the amount. Plus I've had a few loose ends on cases recently."

"Sure. Well, ... you say you settled it?"

"Yeah, OC US atty we both know and I emailed each other as part of negotiations."

"So sue for breach of contract for $400. I mean, you'll be in federal court though because they'll remove it from small claims."

"Well i mean, we clearly settled so i think US atty will just pay once it is in state court rather than remove. Anyway, here's the email chain reflecting settlement."

"Thanks. (moment to read) Dude, there's no reflecting that $400 was a done deal. You floated it out there but there's no confirmation that your demand was accepted. Do you have written confirmation anywhere?"

"What! No! It's only $400. Jeez dude you are making too big a deal over it. Okay okay I'm pretty sure OC she CALLED me to accept."

"Well, I mean, if its contested you'll have to testify to that. Sorry dude thems the breaks."

CALL in to US Atty--"No, we never accepted that! Why should we--there wasnt even any injury. No I didnt call to convey acceptance."

SP to colleague: "Dude.. you are going to have to testify. and if you know you will have to do that you can't be counsel on the case, PARTICULARLY if this stupid thing gets removed to federal court."

"Well, uh, can you do it for me? Please? I mean I've been feeding you PI cases so you can make your nut."

"Fuck. Okay, I'll file in GDC state court. the judge there happens to be the wife of a federal court judge and maybe we can just pillow talk this bitch. lets see if the USPS just pay it rather than go thru the rigamoarole of removal. And i'll put snarky language in the original state court pleading saying how dumb it is to litigate over this in case it is removed."

"Thanks dude."

"Okay. I hate you."

"Ha. You wont hate me when I send you a case you can make a few grand on personally."

"All talk."

And so there we have it.

I left the firm shortly after the case was removed and i was so disgusted with it I think i literally just walked away from it--or tried to transfer it over to the other atty and he refused and I said "fuck it fuck this and fuck the horse you rode in on."

Now THAT was shitlaw.
