Hearsay is an out-of-court statement used to prove the truth of the matter asserted.

the other class i got a C in was income tax. i got a bad cold the night before, and dimebag from pantera was shot to det the night before as well.

It’s fundamental and not hard. Of course I took from Larry Tribe, so instead of focusing on rules we did the hearsay triangle.

AI Overview

The "triangular model of hearsay" is a framework for analyzing hearsay evidence created by Harvard Law Professor Laurence Tribe. The model is based on the idea that all testimony in court is susceptible to flaws, and that hearsay evidence is subject to two sets of flaws: those of the original declarant and those of the in-court witness.

The triangle has two sides:

Left side

The jury can't be sure if the fact was:

Clearly or ambiguously stated

Delivered with sincerity or duplicity

Right side

The out-of-court assertion is only useful if it's not the product of:

Faulty perception

Erroneous memory

The hearsay rule protects against these dangers. When attacking hearsay evidence, an opponent can use the triangle to question the in-court witness or in closing argument.

The good thing about Tribe's class is that it gave a basis for deriving rules of evidence without having to memorize all of them and the exceptions. Effective on things like the MBE where you don't have to cite an actual rule.

no, it's just a catch-all to remember. it's rarely used in practice, but for multiple choice exams it can be used when the evidence should be excluded by none of the answers explaining why are accurate. in that case, the answer might be 807. just a way exam writers trick people up.

hearsay routinely pops up in administrative hearings, of course whatever is admissible is up to the alj's discretion and can come in under the administrative law evidence exception
