Garcia’s lawyers ask the Judge to return him to Maryland and bar ICE from deporting him while awaiting trial. Not clear to me the judge even has the authority to do that since existing immigration law allows ICE to treat immigrants like farm animals

Seems like a win/win to me. If the court accepts the government's argument, the predator stays locked in a cage until the end of this proceeding (and be deported anyway afterwards, possibly after a prison sentence). If the court rejects it, great, let him out to be deported and the court can't later say they weren't warned. Gotta think two steps ahead.
