Successfully argued and won a reversal on appeal of a federal district court's dismissal of petition to compel arbitration in a case arising from the death of a participant in a hike up to Mount Kilimanjaro, Tanzania.

Secured the pretrial dismissal of a federal lawsuit against a tour operator that arranged an excursion to the Inca ruins at Machu Picchu, Peru. During the course of her visit, the plaintiff fell down several plateaus, suffering serious injuries.

Successfully argued before the Supreme Court of Florida that a parent not only had the authority to enter into a contract with a travel agency on behalf of her minor child but that the arbitration provision contained therein was taking valid and enforceable. The case involved the death of an eleven-year-old boy who took an African safari with his mother, and was killed by a hyena while there.

Yep. Can vouch for what you said. Been on several safaris including in Zambia and had bush walks. They always included guides with weapons and strict instructions for what to do. The guides have intense training for years.

This is clearly a tragic accident that somehow got out of hand but every day thousands of tourists are doing bush walks on remote safaris and nothing happens. It was also drilled into us the risks of the wildlife and never leaving the tents at night unless with a guard. I remember on my first safari in Kenya at a fancy tented complex overlooking a small creek with hippos, the first night I did crack open the tent flap just to peek outside and spotted, about 20 feet away in the creek, a pair of round goldish eyes of a hippo staring back. Zipped the flap right back up as got the point right away.

Kenya: Masai Mara and Amboseli. Have to say enjoyed Amboseli more, loved the Sinet delta and watching herds of elephants marching towards it and wallowing in the water and the amazing variety of birds. But Masai Mara was where we saw the crossing of the wildbeest and did (ouch) witness one snapped up by a crocodile. Masai Mara was where I saw the eyes of the hippo through the tent flap. But maybe the coolest nighttime experience was at Amboseli where we stayed in a small camp that was ringed with thickets so you could walk around at night (it only had maybe eight tents I think). While waiting for dinner I went over to the gates that are shut at night and have a 1-inch crack between the two panels. 6-7 ft high. Just out of curiosity, I lifted a flashlight over the gate and peered through the crack and saw the outlines of a lion (so I thought) strolling past, maybe 20 feet from the gate). It turned towards me and I saw the golden eyes. Excitedly told the camp managers and we all immediately rode out to see if we could find it, and we did and it was actually a leopard. Amazing.

Tanzania: serengeti and then Ruaha. Serengeti was amazing, though Ruaha felt perhaps more of the same wildlife in a different setting. At Serengeti we stayed in hotels outside the park and drove into the park each day but in Ruaha we stayed in the park proper in camps and had elephants wandering through our camp. Which is both neat and not so neat.

Zambia: South Luangwa. Very intimate safari environment, it's not the vast open savannas of Kenya or Tanzania but beautiful. Saw lots of lions and elephants and one particular day was like a Disney movie with every 100 feet unfolding another amazing cluster of animals. Will never forget a baby elephant wallowing in mud while its herd patiently waited and then when the herd started moving away, the elephant stood up, shook, then made a clear "wait for me!" sound and hurried to catch up. Had a brai on a dry riverbed while lions called in the distance.

Never made it to Okavango. Someday. Kids got in the way.

in the serengetti, we saw a pack of 8 lionesses stalking and encircling a hippo who was walking around outside the water. the hippo somehow managed to scare the lionesses away and got the fuck out.

we continued to follow around the hippo, who must have been on edge and maf. at some point he just started charging at our jeep. he was like 10 feet from us. our guide was scared shitless and drove the fuck away as fast as he could.

Here's my legal analysis:

1. What does it mean that the guides left the area? They just led the tourists to an African river filled with hippos (and probably crocs and 30 other dangerous species) and peaced out? That sounds like negligence.

2. I think its not a good fact the tour booker is called "The African Portfolio." If it was Joe's Travel Agent, I'd have more sympathy. But it sure seems like they're advertising themselves as experts in the space and they better have done some diligence on the tour operator.

1) seems preposterous that they just peaced out so we're obviously not getting the full story. this is the DM's summary of a one-sided, self-serving complaint. it's literally impossible to assess negligence based on what we know. this is a situation where any number of things could have happened, and it could be very negligent or a freak accident. we have no facts.

2) i dont think their name matters. their website says they've been around since 1993 and that they've been recognized "by the esteemed Fodor’s Travel as one of the “Top 10 African Safari Tour Operators.”" if this claim is true, they're not some fly by night operation and probably have their regular local operators they've vetted and use all the time.

i quickly searched my regular travel boarts, and there are very old and very current poasts recommending them, including people i know who are regulars and mfes. so they've been around and are legit as far as i can tell.

in uganda i stayed at a camp that was right in the middle of a national park, at night a furking huge ass hippo was right outside my tent eating grass, i cldnt go outside to pee so i pissed in a water bottle

they also wld have lions roam thru the camp, there was no fence at all, that didnt happen when i was there but some elephants came by

when i was in zimbabwe some dude was at some other nearby camp and one night he went to the toilet and a lion furking raped his ass and killed him, damn found the article it was FIVE LIONS MAULING HIM, what a peak experience while fully nude:
