Costs through trial on this case were over $180K. Plaintiff's ERISA liens were at $160K which I got down to $110K during settlement efforts. So in order just to get her the ability to buy a modest house and live out the rest of her days there on disability, we'd have to settle somewhere around $900K.
Carrier would not even get in that range. Carrier literally invited a paid mediation and came to the table with $200K total, knowing full well what our costs and liens were. |

Jury deliberated for about 5 hrs. Given the brick wall of bias that was manifest with some of the jurors, I would say the presentation was as effective as humanly possible. I am convinced no one could get a better result for the plaintiff under the same constraints. Does this help?

So, the jury asked a question about four hours in: does the decision have to be unanimous.
The judge answered Yes. A couple jurors sighed heavily and all trudged back in their room.
Then Jury went to lunch 10 minutes later
They came back from their separate lunches in an hour and within 20 minutes of additional deliberations had a verdict. Verdict was find for defendants.
Presumably some jurors said “look I’m never changing my mind” and other jurors said “fuck this retard I need to get out of here and make money” and so they just changed their finding for the plaintiff for a finding for the defendant just to end the matter. Complete disregard for their sworn obligation of course.
The whole thing makes me want to gouge my eyes out. |

I spoke to XX the smiley guy in the front row who was the only one who would pick up.
He said they found the defense experts more credible overall, just because. He said they found the records alterations indeed to be a big deal. He said the verdict form was confusing because it looked like if you found for the plaintiff you had to award $3 million. We have no idea what he was talking about with that it was literally a line to be filled in and we TOLD them How to do it and that it could be a lesser or greater number.
He said they hated how many times they had to go in the back room for hours. He said he was mad at the judge for not making the lawyers pick up the pace in questioning. He said that everyone was DONE on Monday and no one wanted to come back on Tuesday. He said they felt sympathy for the plaintiff but not enough to give her money when they realized it would have to be a substantial sum to make a difference for her. They were at 5 to 2 w five against when they went to lunch and when they came back they just decided that majority wins. So just as we thought. So much for doing their job.
He said the alternate was the foreperson until he was kicked and then office clerk was but she didn’t want it. He didn’t know if alternate was for or against. Reiterated that he hated how long the breaks were and having to go in that room for hours at a time. Said everyone was waffling the whole time also.
