-The DC Circuit, while important, has a very low caseload, and these three judges are not going to have a very significant impact, especially with a lot of senior Reagan-era nominees still staffing cases.

-Maybe his goal is to staff the bench with 50- to 52-year-old judges who'll be shortlisted for the next Democratic administration for SCOTUS. But that's a very very long game and assumes that no one else in the wings is any good for a short list.

-There's only a couple of years left in his term for him to even get nominees through, and he's nominated at a lower rate.

So while I get that Obama and Reid have advantages to going nuclear, doesn't this, in the long run, likely fail a Rawlsian test in terms of long-term advantage?

Anyone liberals want to defend on the basis of something I'm missing. tyia

Stupid to say DC Circuit requires 11--when it had 12, they cut a vacant seat and moved it over to the Ninth Circuit in 2007 because the DC Circuit caseload is so low. They should cut it to 9. But the GOP is stupid for saying "well it's so low so we should just leave it vacant." No, the solution is to statutorily amend the number of seats on the DC Circuit, not to refuse to fill vacancies.
