got my first $280k "Personal Injury Judgment" today

First time I've ever put on damages in a tort case and first time I've ever requested punitives.
Defendants showed up but had no argument.
Only problem its against some deadbeats that are worth nothing.

options now are to go the long haul wage garnishment route (unless they file for BK then we are fucked), which will be not much money.
My PI buddy is suggesting a possible other option where we get defendants to assign us case in exchange for not collecting and using the bad faith laws in the state against the insurance company for not providing coverage. We are looking into this.
Facts: Car wreck where dude took his mom's car and got super high and hit my client. Insurance company wouldn't provide coverage since driver wasn't on mom's policy. We included her as a party for negligent entrustment.
I could also use some suggestions from PI mastermen on xo for this. |

Then you can get a default judgment against the insurance company. My guess is if you got punitive damages the bankruptcy court will determine that there was a "willful or malicious injury". So you should be able to successfully contest a bankruptcy discharge. they appeared for the motion for default hearing. Judge let them testify but they didn't know what they were doing. Kind of feel bad for the mom.
I also rolled the dice and called the driver defendant up on direct, tried to get him to admit that he was charged with DUI (which he did, whew!) for our punitives claim. Otherwise I only had my client's testimony that he knew that the driver got charged with DUI. We didn't try to admit the DUI police report because it was hearsay (but you guys could school me on this - I'm not sure our copy could be called an official record). |

remember insurance company people arent lawyers and they traffic in fear and risk only so u can scare them with made up laws and unhinged letters |

Great starting point for exactly what you're looking for is the spyderco para 3 lightweight. I've recommended this knife to a few people, and it's very popular.
With a 3" blade, it's going to be legal everywhere. You can easily deploy it with 1 hand, and it has a compression lock, so it will be rock solid when open until the lock is disengaged:

another spyderco option that costs about $15 more is the sage 5 lightweight. I'd say the extra cost is worth it here. for the better blade steel and construction. I also just think it's a little nicer looking.
If you are open to buying a chinese brand knife, the brand civivi makes probably the best bang for your buck in the $60-100 range. The elementum is really popular and it only costs like $50. I just picked up an imperium this week which is like $75. Love it. |
