First jury trial in almost 2 years. Clear liability decent impact hit. Liability is accepted. Our clients each did a bunch of PT, some MRIs, and 1 injection each. Meds were high 20s. Our 998 offers were $29,999 from like 3 years ago. Defense 998s were $10,000 each (ridiculous).

Defense asked us a couple weeks ago if we would still settle for 30k/each and we told them to fuck off. If we beat our 998s we get 3 years of interest on the verdict plus all our expert costs (probably 15K).

Clients present pretty well. Girl is a dental tech and dude works at a brewery.

Jury selection is starts tomorrow but will probably take 2-3 days because of COVID. I can't imagine how many people will try and say they don't feel well to get out of service.

I'll post tomorrow at the end of the day if they actual start jury selection.

I sent my first offer of judgment (our version of the 998 offer) and am waiting on the response right now (they are Allstate and will probably not accept my offer, apparently they never do).

About to file my first small claims type car wreck case.

I've never tried a tort case in any form, even though I've done dozens of contract cases. Still wrapping my head around trying to prove pain and suffering.

Got a jury verdict of 46k and 15.6k. Beat our 998 of 25 months ago on the first one so it should end up being 73-75k after interest and costs. On top of this as prevailing party we get our depo costs and filing fees and everything else back. The 15.6k is disappointing but we beat defense 998. That client went to the ER with back pain ten days before the accident and didn’t tell us. We beat the defense top offers (even before our tens of thousands in recoverable costs), so they won’t recover anything back. At the end of the day they will pay 130-150k including defense experts on a case they could have settled for 60k in 2019.

Despite it being a victory, it’s a slightly disappointing one. I expected more.
