I still don’t understand how some of this DEI shit isn’t turning into giant lawsuits all over the place. An old employer announced “goals” after George Floyd that were straight up quotas. They hired this guy away from a bigger name in the industry to be the CDO and it was supposedly this huge deal that the entire C suite was so proud of. He would make a massive difference in recruiting supposedly (lol). He comes in and after three months announces this “big idea” he has to have “goals” to hire so that the workforce is at least 25% URMs and 40% women in both IC and management roles, which would more than double the then current levels. I asked the lead employment counsel (who was hilariously a straight white guy and for sure a Republican though he hates Trump) and he said they took it to outside counsel and got it blessed. I asked who the outside counsel was and he literally named a “civil rights attorney” who is the CDO’s former frat brother and they worked together for 15 years. Translation: they were all too scared to tell the C suite that this big hire they are so proud of is a fucking tard.
The hilarious post script was that the guy apparently sexually harassed a chick at his first big conference and was gone in a year.

It's what I said in the other thread. The game changer isn't Roe, but striking down affirmative action as unconstitutional.
Most of you don't realize how extensive the bureaucracy is overseeing affirmative action and how it influences every HR department in the country or ideologically committed to the righteousness of DEI among Fed and private sector HR.
You could make a compelling argument that it's the mole allowing wokery to creep into every corporation and university, who have to provide data on employment, recruiting and hiring demographics. Trigger happy DAs in California were/are eagerly pursuing cases against big tech for not being diverse enough (Asians don't count), which led to all the joke soft jobs at the FAANGs, which is how wokery crept into those firms through the backdoor.
While abortion is mostly an abstract concept that will change nothing in the blue states where most of the abortion activists live, the SCOTUS declaring affirmative action unconstitutional would have immediate impact on every state in the country, as well as for the large class of AA/DEI grifters and HR specialists in state and fed and local bureaucracies as well as universities, and from there, the private sector. This would be far more an affront to progressive sensibilities than abortion because there would be no safe place for AA proponents to retreat to, as AA would be just as illegal in Massachusetts as in Texas, and provides conservatives with grounds to challenge AA in the blue states too.
Based on the recent SCOTUS rulings, it's very hard to see this court not striking down AA next year.
Ultimately, the US is barreling towards a major clash of values: whether we believe, as a people, that all people are created equal and the same law must apply equally to all, or whether we abandon legal equality by continuing to carve out exceptions and privileges for special groups of people.

the goal of having an "accurate representation" or whatever will remain in place. it will be exceedingly difficult for the fed gov to take on this charge with any degree of transparency, but universities and other such enterprises will expand far greater resources on getting around this issue, making today's HR "I cant deal with wypipo" stuff seem quaint.
as others have mentioned the first to go will be any some of "objective" metric such as a standardized test.
as from the harvard case, they already invest tons of resources in evaluating black applications to give them extra points for personality or whatever vis a vis asians.
there's going to be all kinds of mechanisms to make sure there are at least 15% blacks.
you are going to see deep "pipelines" from state universities and the like into inner cities to grab all those basketball teens who never realized they could command space ships. those will in turn be admitted bc their references will be immaculate and their essays will be near and dear tot he admit committees vs asians who will be excluded from teh inner city chains

Two comments:
1. If the SCOTUS ruling opens the grounds for lawsuits against disparate standards for applicants for the same spot (job, university place), it will have significant implications for both universities and hiring authorities irregardless of any desires for accurate representation. The same data metrics used to track affirmative action can also be used to show discrimination against classes of people based on ethnicity. With Federal might withdrawn from protecting "positive" discrimination for accurate representation, the same universities and hiring authorities are in very different places. There's only so far they can go in being creative without running afoul of conservative courts and lawsuits.
2. My corp does a substantial amount of R&D consulting shit for government clients, including various Fed agencies. For a long time we had the DBE/MBE quotas that varied in strength. But recently we've encountered explicit diversity requirements among the consultants themselves, so it's no longer good enough to have a token DBE subconsultant firm owned by an Asian on your team. The proposals we submit will be evaluated by how diverse our teams are irregardless of the strengths of the team's capabilities and background. It's tied to the Biden Admin's DEI push and shows you how entrenched quotas and DEI programming and disparate evaluation standards are becoming in the Fed bureaucracies. But if the SCOTUS declares it unconstitutional, what is the Fed going to do? Defy the Court? Expose itself to lawsuits from losing competitors?
Progressives had 75 years of liberal courts and liberal judiciary victories and built an entire metaphysical and cultural attitude based on "reality has a liberal bias" inevitability outlook that was repeatedly confirmed by liberal courts regardless of what administrations came in and out of power. But how will progressives reconcile their staunch belief in righteous inevitability with a SCOTUS that no longer favors them, and is ruling decisively against them, and threatening to make deeply held beliefs unconstitutional. It affects those who work in fed bureaucracies just as much as in university departments and on school boards. And unlike with striking down RvW, there will be no safe states to retreat to for AA would be just as illegal in MA as in AL.
There is a clash of values happening over the meaning of the word egalitarian. It's between those who think equality means everyone treated by the same standard irregardless of individual circumstances and that disparity among people is due to individual behavior and merit, and those who think equality means having the same outcomes (as defined by identity groups) irregardless of individual merit, and that disparity among groups is only due to institutional injustices rather than merit or individual or cultural behavior. And this clash will intensify.

The customer isn't clamoring for DEI shit. If anything, the customer hasn't demanded anything. It's deliberate decisions in boardrooms and advertising. Some of it is ideologically driven, but on the corporate side a great deal of it is protecting themselves from liabilities. It's easier to pay consultants for DEI training than to have angry activists accusing you of racism on twitter and ideological DAs breathing down your neck. Just look up what CA's AGs have done in investigating companies.
So much of what corps do is legal counsels and HR telling them what to do to avoid DOJ or DOL looking at them, regardless of the merits, or to minimize exposure in hypothetical suits from angry ex-employees. Half the companies with rainbow logos this month are only doing it to make it harder for hypothetical angry ex-employees to sue them for hostile workplaces.
I'm on calls with my legal teams all the time and it's always "it's better to do x and y and z" just to keep the Feds at bay.

I don't claim to know what the aftermath would be, nor advocate a return to blatantly racist and sexist hiring methods.
Overturning AA and declaring it unconstitutional, which isn't difficult as it does contradict certain sacred principles of the Constitution and various amendments, would make the matter much more nakedly open. AA existed because it had the backing of federal authority, which was real and extensive. For a long time even the federal authority tacitly admitted contradictions existed between AA and the Constitution, but it was for the greater good, as earlier rebuttals to challenges to AA by the SCOTUS decided.
But if that authority disappears overnight due to a SCOTUS ruling, people would have to be much more conscious of whether to defy it in underhanded ways, or embrace it.
For a long time the progressive left were able to steamroll ahead with their ideologies by claiming the law was on their side thanks to decades of activists courts. And conservatives always fell in line because the law was on the progressives' side.
But with the court no longer clearly on the progressive left's side and the beginnings of key progressive ideals undermined by the court, the left will have to chose either to respect or disregard the law. What they will do is the unknown factor. But it is a serious problem for the left in ways it never was before.

The biggest impediment to rightwing victory is normies on the right clinging to the delusions that "we live in a country of laws not men," "process matters," "it's about the principle of the thing," "I just want to be left alone," etc. That is all facilitated by a fundamental -- and deeply misguided -- belief that, at base, The System Works. Who cares if we keep losing ground over and over again as long as The System Works and we can hold out hope that eventually we will find ourselves the winners within it if we just continue to have faith and follow the rules?
As soon as those beliefs go out the window (and by every metric they're all falling quickly at this point across wide swathes of our society), the right will be forced to engage in the real game afoot: a brutal struggle for raw power. And putting aside all of the bullshit about how much "richer" and "better educated" and "tech savvy" or whatever else the left claims to be (and perhaps even is), in an open struggle for raw power in 2022, the far right in America would absolutely dominate the far left, and it wouldn't be particularly close. Smart leftists recognize that, which is why they seem so nervous and anxious these days despite ostensibly "holding all of the power" under the current system. Their greatest defense has always been and still remains hiding behind the mask -- but it's slipping hard and fast these days. Good luck, libs.

We are in a weird moment when the left spent the last two years accusing the right of wanting to overthrow democracy, and now the same voices are accusing the Supreme Court of losing all legitimacy with the recent rulings (see recent screed from Warren). So who is wanting to overthrow democracy now?
There is a very good chance in two years' time we will have all branches of the government in firm control of the right. Imagine what a DeSantis administration could do with a sympathetic court and Congress? I know some people on here don't like DeSantis because he isn't Trump, but because he isn't Trump, he's much more disciplined and we've seen enough of his beliefs and policies to know he sees the root of the wokery rot in the Federal bureaucracy and Federal policies like Title IX. If people thought Trump was a bull in a china shop, DeSantis could be the nuclear armageddon.
Then what will the left do?
If both sides increasingly see the other's hold over branches of the government as illegitimate, what are we left with to govern ourselves as a single people?
It's why it's hard for me not to see some kind of real reckoning in the latter half of the 2020s. It's not violence on a meaningful level but the masses of people will clash against each other in ways that will lead to outcomes we can't quite foresee.
