You can get seriously hurt in a minor accident and a lot of lawyers don't help their clients because they are afraid of a fight on causation. Sometimes lawyers even tell their clients NOT to treat for pain because they are afraid of the insurance denying causation. The amount of property damage is irrelevant if your client is in pain. It makes no sense to go after someone personally who has a 100K policy and 50K in a checking account. I do go after people for amounts in excess of the policy if the injuries are large and the defendant is underinsured. For example, once we had a client injured by a wealth guy who had a 250K policy but no umbrella. We got an additional 400K in personal contribution on that one.
