I'm guessing this is a common scheme. Much of the settlement value is probably pre-filing to avoid bad press, seems hard to prove up a 9B fraud under these facts (although it is, unquestionably, a fraud in the everyday sense of the word)

Often though in fraud suits there is a dispute over reliance, ie, even assuming X lied to Y, it's not illegal unless Y relied on the statement. And CVS will argue you have to prove reliance on a person-by-person basis (which is impossible)
Here they also sue under all states' unfair trade practices statutes; those statutes *might* make it unlawful to lie to customers even in the absence of reliance. probably varies somewhat state to state |
