The Brittney Griner prisoner swap is just the latest in a long line of reprehensible norm-breaking statements and actions by President Joe Biden. Just within the last few weeks, he tried to unilaterally cancel student loan debt, drew down the strategic petroleum reserves for political purposes, and trampled on the First Amendment interests of Americans. As someone who staunchly opposes the War on Drugs (and I have written about it here, here, here, and here), it is difficult to justify sending Russia a known terrorists in exchange for a wrongful drug charge.
The usual excuse for such behavior by Biden is to claim his hands are tied and he's doing what he can in the moment. But I am grateful to see the Institute for Justice (who I have worked with before, here and here) filed a lawsuit in the federal court in the District of Columbia to stop the "swap." If executive overreach is to be stopped, it must be stopped by the courts, because, unfortunately, the political process has failed.
